Cobb Tuning Hit With $2.9 Million Fine Over Emissions Defeat Devices

I am not sure how all these local mom and pop shops get away with DEF\DPF system deleting. It is known that they do it. They must grease someones palms.
They’re small targets yet. It’s easier to go after corporations than it is individual shops. They’re likely using a common tuning solution that allows this to happen like Cobb supplies.
 
The “past precedent” rule should strip all power from any agency that refused to enforce the law as written from day one. Ignored it for 10 years? They can’t start now. Centralized control for things other than defense are fully anti-liberty.
There's no such thing. Agencies are always given discretion with regards to how they make use of the limited funding they're given every year. Surely you don't want the EPA to run down every customer and haul them into federal court? That would cost a lot of money and time.
 
Ive been saying all along that the HD thing and the Diesel cases are test cases, and it is all about revenue, they've figured out they can make money from it, but i'd be highly surprised if they go after any little guys with little potential for a payoff in form of healthy fine...
Naw. It's cheaper from a manpower perspective to spend the resources going after the sellers of these items rather than the customers. Surely you don't want the EPA to run down every customer?

You’re right. They shouldn’t have a budget to go haul people (or corporations, for that matter) into court or fine them unless a grand jury indicts them. Otherwise, an agency with federal powers could become weaponized and simply penalize their way to a larger budget… oh, wait…

Well they wouldn't be in court unless they were indicted. If you want to pay more in taxes to pay for that sort of thing it could happen. You just have to ask nicely. lol.

I would argue that a manufacturer intentionally creating devices and tunes to delete emissions systems shows a lot more intent than buying a product to do so. I still wouldn't do a cat delete, but I'm fully aware my tuner can do it without a check engine light. I've been wondering how so many still offer this option after APR already got busted for it.

Simply zip tieing the rear O2 to the frame or body defeats the check engine light on a converter delete.
So are zip tie manufacturers going to get sued too?

They’re offering a tuning solution that allows everything to be properly hooked up and not create a check engine light. They’ve put a lot of research into this to charge $600 for a tune to do so.

I don’t understand why you’re so bent on defending this. Grounding the plug likely isn’t something that works on modern cars which is what they’re tuning out. This works around that issue.

Seems to work on 2000s dodges. Most people just use spark plug non-foulers.

I get that there are other solutions, but these tuners are getting in trouble for developing specific software to work around this.

I’ve done the anti fouler thing before on a 2005 Nissan. It still is using the O2 sensor, but backs the sensor pickup out of the flow enough to look like the cat is working. I still had a cat on the car, but I removed the cat inside the exhaust manifold when I installed a header. It was the lazy solution instead of extending the wires and installing a new O2 bung.
 
Vehicle emissions are irrelevant in about 99% of the US by land area.
For example new Mexico (120,000 square miles), only Bernalillo county (1,160 square miles) requires emissions testing. About a quarter of the states population lives there. Most of that is crammed into less than 200 square miles.
That is a cherry pick stat. Where emissions matters has a very high concentration of population of the entire USA.
 
Ever drive behind a car where bro removed his cats? In Ontario it seems super common.

I even saw a Ferrari 458 where someone must have done this.

Aftermarket exhaust was spewing smoke and smelled like ****.
