gate hit my vehicle

So my storage place has a gate that doesn't have a sensor and basically doesn't care whether or not a vehicle is their or not. It also stays open all day and closes in the evening time. Occasionally I show up at the time it closes where you have to type in a code to open it. Well I guess today it decided it was going to close for the night and it hit my bumper making some pretty big scuff marks. What a bunch of bs.

Opinions?

Typically the owner will pay for damages. Most likely it has a sensor and was bypassed.. really dangerous as it could kill someone.
 
They have a sign that says not responsible for damage done by gate, although in court that usually doesn't mean anything. So I don't think the owner is going to pay.
 
Of course the real question is did the vehicle hit the gate or did the gate hit the vehicle? Know what I mean? But I think a gate shouldn't have any business closing if the vehicle is less than 4 or 5ft away. It's just one of those things where you have to live with it I guess.
 
You can't even get this place to answer the phone so that you can give them rent money.

I think you're SOL, unfortunately.
 
I would start by talking to the owner/office manager. See what their response is and go from there.

Then leave a sign saying "not responsible for damage to gate done by vehicle".

For future purposes, don't park your car where the gate closes. And don't stand near doorways, where the door can open and hit you in the face.
