Anyone Deal With Police Harassment???

I like to have a cocktail or two and tired of being bothered by the suburban police. Granted when I'm in the city they don't hassle me. However, when I venture out to the suburbs I'm frequently getting pulled over for "alleged driving violations." It's usually at 2AM closing time when I'm a bit "toasty". Are there any criminal lawyers here that can advise me? I figure I have the right to enjoy myself.
 
This thread, too, will not end well. A criminal lawyer would advise you to quit driving while "toasty" and that your right to enjoy yourself has justifiable limitations.

I'm out and about constantly at 02:00. I get pulled over exceedingly rarely, and when I do, I've never had a drop of alcohol, so I don't need to contact a criminal lawyer about my predilection to get toasty and the dislike the police have for such behaviour.

I'd suggest that the behaviour of the police isn't worthy of scrutiny. They clearly think your behaviour is.
 
Garak, you live in Canada so perhaps there is a cultural gap? Here in the U.S., we have the right to refuse a breathalyzer. I'm tired of being profiled late at night. I get off at work at 11pm and deserve to drink and eat. It seems 2AM closing time they set up roadblocks. Garak, I'm looking for folks who can relate not debate me.
 
There is no cultural gap from being Canadian. We in this province probably have more in common with the average North Dakota farmer than we do with people from BC, or you with people from Alaska. I'm out late, too, and everyone needs to eat. And I know why the police pull people over late at night. The chance of nailing an impaired driver is very high, and in a low traffic/low crime area, the SOP is to pull over everything that moves. How's that for a cultural gap?

In any case, if you think that they're setting up roadblocks at 02:00 to harass you, well, I don't know if a criminal lawyer is the correct professional to be calling. Additionally, if you're looking for people with whom to commiserate about impaired driving, you're in the wrong place, speaking of cultural gaps.
 
I used to read about all the drug busts on the NJ Turnpike from cars that the state troopers pulled over for a burned out taillight or a unsafe change.

I don't know the color of your skin or what your drive, but in some towns you just need to be a bit darker and you'll get pulled over for alleged driving violations.

The cops know when the bars close and that there will be "toasty" people on the road that shouldn't be driving. What you call harassment, they call proactive policing.
 
I'm from the West Side of Chicago. Where I probably have a better chance of being shot than hit by a drunk driver. Your "holier than though" attitude is not needed. If you don't have my experience, why bother responding?
 
I'm not hip to the lingo. What's "toasty" mean in this context? If it means soused, lubricated or tiddly, then yes, the cops should check you out.
 
Drinking and driving should never be mixed. The consequences are too terrible to contemplate and have nothing to do with getting a ticket or being arrested. The goodie, goodie campaigns are a bit less than a success. The police are not the problem. They are the solution in the absence of self control.

"Not end well" all you like, pretty common knowledge around here that cops are more or less above the law, except in the few times that justice prevails.

Is everyone squeaky - clean innocent? No, usually not, though sometimes yes, and does that excuse certain police behaviors? I think not.

There is a reason drowns happen when police are mentioned. We all know how they usually get down, given the chance.. in this case, a handcuffed suspect.

The issue here is "excessive force." Also, "assault."

I see the "usual suspects" post to condemn me. I'm looking for others who enjoy a good cocktail without harassment. A .08 BAC is not a good measure of impairment. Of course, it's PC to say today and I'm from back in the day when the police just gave you a ride home!!
 
Typically the only people on the road after midnight are cops and drunks.
Your choice to drive while "toasty" is not only irresponsible but a menace and if your lucky you'll only get charged.
Having had more than one family member injured by a drunk driving retard I truly hope when the police pull you over they acquaint you with their taser and billy club.
Being impaired not a single person would believe you weren't resisting. Hopefully they impress upon you the importance of sober driving and beat you to within an inch of your life. Since you care so little about it.
I couldn't care less if you end up street pizza,I do care about the people you "accidentally" hospitalize while behaving so stupidly.

1. .08BAC is DEFINITELY DWI in NJ. SOL.

2. For all the stuff I do (I draw heat from people on things I do on the road that may be against the letter of the law, don't DARE have anything on the rear view mirror either or on your license plate, ANYTHING, that's against the law here too,) .. but I NEVER NEVER, drink and drive.

It's just stupid, and I agree with Clevy.

Same for buzzed and "high" driving.

Now, how long until lawmakers apply that to energy drinks... they haven't yet.
 
Nick, you gave me a link to AA which I was mandated to in the past. In my immediate area the police do not give a rat's tail about "impaired driving".

either cut your losses by figuring a way to get off the radar, or go all the way and possibly get a Pyrrhic victory.

I suppose, evaluate what's important to you in life, and how much time do you have on your hands...

GTFO. Do you carry a breathalyzer so you know you're not over the legal limit? In most states you don't even have to be over the limit. It's the cops discretion if you're impaired or not.

No offense, but if you're tired of dealing with cops when "toasty" out on public roads, maybe drink at home? Get a cab? You know, sensible solutions instead of whining about police harassment after drinking and driving.

Sheesh. I hope you get a DUI so you'll maybe come to your senses as to how delusional you are.

This coming from someone who has had a DWAI. It's a serious matter and you should probably take it that way.

I like to get moderately drunk pretty often. I want to drive while what I call "not drunk" and expect to not be harassed about it. in fact, I need a good lawyer to sue the police. Anyone got any leads?



That's how you sound, just thought you'd like to know since you're unaware.

I have, and he lied on the police report. Needless to say rhe judge shook his head with embarrassment and dismissed the case.
