Why do you think the fool driving the motorcycle won't have his brains sued out? Passing multiple cars on a double yellow - wanton disregard for the safety of his passenger. Intentional act, well beyond negligence, insurance may decline to cover it. Old drunk committed an intentional act of violence - no insurance coverage there - and won't be able to discharge it in bankruptcy because of that. The moron driving the motorcycle was well beyond negligent as well, bankruptcy may be unavaible to him as well.
BTW, what's the point of this? Are we supposed to feel sorry for motorcyclists that violate all the rules of the road, expect everyone else to obey the rules, and then want sympathy when there is a disastorous consequence? Sorry, not feeling it. Well, I feel it for the girl - she made the mistake of a lifetime getting on a motorcycle with that butt clown.
