My E90 got hit while parked

Y'all:

I was up in the Bay Area for business and had a late breakfast at the Los Gatos Cafe "Uptown", Sue's and my favorite breakfast place in our old stomping grounds up there.

While walking across the parking lot after breakfast I heard a car alarm screeching. As I approached the E90 I noticed it was cocked at an angle inside the parking space, when I had parked it straight in. You can see in the picture how the impact moved the car about 18 inches forward and sideways. Front wheels got knocked to the right too. They may not have been 100% straight when I parked, but they weren't turned that far to the right.

Some guy in a stake bed work truck hit it while making a U-turn around my car, which was parked in an empty portion of the lot. Props to him for not fleeing the scene. He was courteous and polite, and I could tell he really felt bad about what happened. We exchanged info. While he was speaking to his boss I asked if I could talk to him. I did and gave the guy props for being honest and cooperative.

He snagged the front crash beam, which pulled down the left headlight. The plastic super structure below the headlight is crushed. Bummer too the fender got hit. Besides the leading edge there is a bulge at the 1 o'clock position over the wheel well opening. The reinforcement crease inside the fender lip is dimpled and folded over, which seems to me will be a weak spot, unless they replace the fender.

You know, when leaving this morning I walked into the garage with my E46 key, thinking I was going to take that. But as I approached I changed my mind and took the E90 instead. I would have been REALLY unhappy had the E46 gotten hit.

You guys know how I take car of my cars! I'm not happy about it but stuff happens. I'm guessing about $5K worth.

oh man what happened to you is what goes through my mind every time i park my G30 anywhere. at least no one got hurt
 
My neighbor has collector cars, really nice stuff he's had rebuilt and/or refurbished. He's says they might total it. I have it insured with Hagerty for $15k. Suppose State Farm (insurance of guy who hit me) pays only $8k. Wouldn't Hagerty make up the difference?

I can't imagine it being totaled for this, but I'm no expert in body work costs.

Let's hope not. It's a really nice car that's been treated exceptionally well; and it has complete, detailed maintenance and repair documentation since day 1.

I hear you! My absolutely PRISTINE E46.....the only time it's outside is when I'm sitting behind the wheel driving it. I don't let it out of my sight, which in a way has rendered it useless.

@slo town, sorry to hear that happened.

I follow this guy on Facebook, he fights for dimished value and insurance claims independently, also for the true value of your car. I’m pretty sure his fee only comes if he can get the extra money out of the claim for you. Look him up on Facebook he’s got alot of examples.

 
Property damage. The responsible party is taking responsibility. A nuisance in the grand scheme of things. I went to Home Depot today. Drove into the parking garage. From a parked minivan less than 10 feet from me a toddler popped out and ran blindly towards my car. The parents were still in the car, probably completely unaware. Luckily I always go super-slow in this parking garage because it's a tight one and there's always someone carelessly coming around a corner or backing out. A toddler pinned under the car would be rather "awful."

I don't think anyone would dispute that.

Sorry to hear of the incident.

But I agree with your neighbor. Given it's age, availability for parts (considerably longer lateley), body shop wait times and diminished value, there's a good chance it's totaled.

Haggerty is probably not going to cover anything when the other party is at fault. Besides that if you tell them they will probably question why you were driving it as they are one of the most restrictive and expensive classsic insurers. I have 7 classics with American Modern that cost less then people I know with 2 cars covered with haggerty - and I can drive them more than just to car shows and with the same agreed value. Check them out and compare. I been with them over 12 years.
 
Sorry about your loss.

I'd be concerned about the steering rack and related mechanicals.

The radiator supports on these are composite. If a tab is broken or a crack is found anywhere, it has to be replaced.

Structure should be measured from above and below.

Overall looks repairable. I would take it to a BMW certified body shop or another shop with lots of certifications.

State Farm will write for aftermarket and junk parts on the estimate. Recycled or aftermarket headlight and bumper cover including hardware. Recycled headlights might look nice but they are often re-sanded and clear coated (without UV protection) from the recyclers or re-conditioners.

I am not sure how Hagerty writes their estimates, so you would want to call a rep or at least review your policy. Might be better off filing 1st party and having them subrogate SF for their loss.

With the level of maintenance and record keeping you have performed, it would be a shame if it was totaled.

Pretty sure your stated value policy will get you the entire $15,000. There is a possibility that the car will be totaled, but I suggest that you work through Haggerty, which is an entity very attuned to specialty car values, your car is very, very nice, but I can’t imagine it having a book value close to the stated value. I would also be very careful to listen to what the body shop says, just in case there is hidden damage. To me, it looks like an easy fix, but that could be wrong.
