Any attorneys here?- my case is going south FAST

I was rear ended June of 2011 by a lady driving a company truck with a suspended license. IThe insurance company said go bark up a tree, so I got legal council. I have a medical narrative from a doctor and he recommended surgery for the shoulder injury sustained by the accident. I did the pre-op, then scheduled a day for surgery. All was fine until the day before the surgery. I got a call at 4:30pm from doc's office saying funding hasn't come through and I needed get $6500 to them by 5:00pm, I got the check and got there at 5:04pm. They said "ohh.. sorry when just closed.. " The same lady that called me 34 minutes ago. Surgery was scheduled for 9:00am, So I figured I could bring the check in the morning and procced like normal. NOPE, at 8:00am I went in with the check and was greeted by "I'm sorry, we are double booked" I asked if I could reschedule it two days from then. They said sure. I went in two days and was told the doctor wasn't ready for my surgery. I was LIVID....beyond MAD! I then spoke with my attorney who agreed that I could see another doctor for a second opinion. The second doctor said the pops, clicks and stiffness are "normal" and gave me a Cordizone shot and said have a nice day. a year later, I'm not better and I'm hurting and the Insurance company told my attorney that the issues were not caused by the wreck, but they NEVER has their own doctor evaluate me. My attorney recommended going to mediation and getting about $30k and no surgery. He said if I look for a third doctor it looks like I'm doctor "shopping". I'm not I just want my shoulder fixed. Even the PT said my shoulder isn't normal.

The insurance company won't pay because they don't believe I will use the "whole" settlement and NOT get the surgery done..basically just beef up my claim. THAT IS NOT TRUE, I JUST WANT MY SHOULDER FRIGGEN FIXED.
Why would my attorney just run and hide from this any try to take the easy way out?
My surgery and medical costs will total about $65k

So do you have regular medical insurance?

If you can get one doc to say the problems aren't caused by an MVA then they should make your regular insurance pay.

Eddie, my SHOULDER surgery will total about $65k, are you suggesting I live on pain meds?
 
I can't offer any advice... (oldest sister is a lawyer)

But is surgery absolutely necessary ???
I know you mentioned this accident / injury a few times in the past.
 
I believe it is, over the last 2 years it has gotten worse.

I really don't want to live a doppy live on pain meds
 
Get the pain meds, sell them on the street and use the proceeds to pay for an operation.

What does your primary care doctor say? Do you have your own medical insurance? Can you proceed with them saying it just hurts and I need surgery? If they want to push the accident thing thats up to them.
 
Is my attorney under qualified for this? Why run scared, when they are clearly at fault and injuries happened
 
Get the money


Shop health insurance. Buy one that covers well on the hospital end. See doctor-then give it done (Most/all should be covered under insurance)

Use remaining money to cover things while you are out.


Find a nice desk job, which will let you heal better, and save some of that cash.

I don't even know where to begin with all the things wrong here.

Rear-ended. The presumption is that the driver who struck you is in the wrong, but your insurance company won't pay? [censored]?

Company truck. Sue the company?

Suspended license. Sue the other driver's insurance company?
 
Dave, the way you are talking I would use ALL of it and end up in debt and in the end find out med health insurance company don't like pre-existing stuff. especaily one that would cost them a healthy chunk of money right off the bat.
 
RF, my insurance company "Farmers" was lousy. I dropped them. they sucked. Yes, the insurance company is "bailing out" the company that owned the truck and the lady, who by the way lives in a trailer park with less than 2 cents to her name
