wrt firearms laws, sure - you are assumed guilty first. wrt anything else? No way, NJ is actually a great place to live.

Sorry, sorry I did mean firearms laws. NY and some other NE states as well. WA is OK, not great but does have the western tradition.

I agree - but it shouldn't have gone that way in the first place.

If you have your sentence "commuted" it is not the same as being found "not guilty".

This means that he is stil a convicted felon - and by federal law will not legally be allowed to ever own another firearm.
 
Yah hopefully he will be able to get it expunged or a full pardon. Just thankful he's out of prison for the time being. Fresh free air is better than no free air.

By the time all is said and done I'm betting the NRA and his lawyer will get him his guns back! That's what I'm hoping for.

Nice Christmas present though from the governor...

He's not gonna' be able to sue..period. The sentence was commuted. He was found guilty under existing law.
 
The governor should grant him a full pardon, IMO. Somehow, I don't think it's going to happen.

Can he still appeal his conviction?
 
As I understand it, he filed for clemency and had his sentence commuted because he is filing an appeal.

If it is shown during the appeals process that he is not guilty, he can lawyer up and sue.

I think some of the "facts" of this case are probably lost in the wash. There's probably more to the story than we know. There supposedly were some problems with this particular judge as well.
 
The problem is that we have activist judges and IMO the process was not provided in its natural form with all facts available.

IIRC the judge who caused this was fired.
 
I have read that the judge in this case would not allow certain crucial defense evidence to be shown to the jury.

IMHO the Governor has done the right thing, and in doing so he has lessened the State's liability in this matter.

IMHO Mr. Aitken is a victim of a serious miscarriage of justice. His civil and constitutional rights have been violated.
The perpetrators of this crime need to face justice.
Examples need to be made so that others will be deterred.

The Judge and Prosecutor are officers of the court. As such they are charged with seeing that justice is served in accordance with our Constitution.
IMHO in this case they failed (with malice?).
A long remembered example needs to be made from this case.

Glad he got out! Im a little late in finding this out myself. Hope he gets his 2nd Amendment rights restored too.

I feel bad for his mom as she was the social worker who called the police who ended up locking him up all these years.
