Go read what I've posted in this thread. I never said the biker was justified and said he shouldn't have kicked at the car. But it's completely obvious that the guy in the car tired to totally take out the guy on the bike and could have easily killed him. That right there is reckless endangerment at the least. Kicking at a car in not going to cause any harm to the car driver, only cause some minor property damage. So based on that I'd say the biker is 20% at fault and the car driver 80% for this resulting accident.
