She was in a hurry...and killed her two kids...

Mom tried to beat a train. She didn't see a train coming from the other direction. She survived, her two kids didn't. The video shows the crash, but no bloody details, thankfully.

I understand the need to want to make time. This is just ludicrous. Could you imagine the what's going through the minds of the kids when they were speeding in the parking lot...can you imagine what they were yelling at their mom..."SLOW DOWN". OMG. Those are the last words from her daughters that she'll ever hear.

Tragic. And awful. All because of someone's petty impatience.

Wow..scary Pabs that's what I was thinking. But I thought at first all 3 were killed and my original thought was: "In a strange and sad way Darwin's ways are ultimately for the greater good"

Was her act stupid? Definitely.

But she did not intend to get the kids killed. Can you imagine how much guilt she has now?
 
A fine line intent draws. She intended to race the train. She KNEW her kids were in the car. But yes she is paying a heavy sentence if she has any sense of connection....
 
Some of the trains where my parents live stop in the middle of town splitting the town for an upwards of 30 minutes.

No one knows the consequences of her being late to wherever she needed to be. Controlling husband... Ba$tard boss etc. Yes, it was a poor decision, yet I have raced 1 train fearing my job.

How about the woman herself! I just don't see how racing a train is ANY less dangerous than playing with a gun.

This is a clear-cut manslaughter case, and it should be charged as such and prosecuted to the fullest extent. No she didn't intend the deaths -- that would, of course, be murder. In this instance, her conduct, preserved for all to see on the video, showed a clear, reckless willful wanton disregard for the fully foreseeable consequences of her actions. That makes it manslaughter or vehicular homicide (particulars will depend upon the law of that state). This is NOT like a tragic case in which a parent does something that's merely negligent and causes in similar deaths. Negligence is the "reasonableness" standard (in roughest terms). What she did goes far beyond unreasonable, and notwithstanding her own feelings of guilt, she deserves to go to prison.

I live about 15 miles away from the crash scene, and Ive been over that crossing many times. What happens in that area(Hammond Indiana) is slow moving freight trains often pass by the area, and many people try to beat these "slow movers". That particular crossing has no gates, only blinkers, too, which adds to drivers thinking they have a chance.


It was also reported that the 2 kids that died were not wearing seat belts, the smaller ones were in car seats. Not too sure if they would have helped though.

Very Sad, 11 year olds shouldnt be corpses.

There's more to the question than one might think. For example, let's hypothesize that she was driving like that because someone in the car was experiencing a true life-or-death medical emergency (arterial bleeding, asthma attack, etc) and the hospital is on the other side of the tracks. Might it be a defense (where you don't negate the prosecution's proven facts, but add more facts that "decriminalize" what appears to be a crime -- think self defense as an obvious example), or does it simply eliminate the reckless element (as in NOT willfully disregarding the foreseeable consequences, but rather, desperately trying to save a life and not seeing things "rationally"). As some of the friendlier posts above have suggested, from one point of view, it hardly matters, as I'm sure this woman (unless she really is evil) will burn forever in the flames of her own guilt without any help from us or a judge or jury.

And the rest of us are being punished paying for her prison time. I wish prison would be tougher and she would suffer by hauling a ball and chain around. How about public wippings.

I predict that some of us will actually see ourselves forced to retire that way. Beats living in the gutter in poverty. One guy recently shoved his terminally ill wife out the window because he couldn't afford her treatment. I suppose he's going to retire to 3 hots, a cot, TV, exercise and great medical care.
 
During their lifetime, 1 out of 5 Americans spends time in prison (not counting jail). Don't remember where I saw that statistic. 1 out of 5!

PS: Check under your bed. Illegals are living there.
