My VW sacrificed itself to save me/daughter yesterday

I know. What leverage can I use?
Read up on your state's laws and regulations for auto insurance. One that most people know nothing about is that the insurance company MUST pay for a rental car even if you do not rent one.

Have you seen a doctor? Especially you, but also your daughter should see a doctor to document injuries. You are entitled to at least a pain and suffering payment. Not to mention the PTSD you are experiencing. Go for policy limits, you can negotiate from there. If they dig in, get an attorney.

We were taken by ambulance from the scene straight to the hospital.

Unfortunately this isn't my first go 'round and I have used an attorney before. I have pre-existing conditions in my neck from previous wrecks that this one darn-sure exasperated. Not sure what to do here though.
Use an attorney again. Don't accept any final settlement offers until you know the full extent of your injuries, your chances of full recovery, or if less than full recovery, what your limitations will be.

Snowy roads, teen driver lost control and hit us head on @ 35+mph. Daughter is fine, I have sprained R ankle, whiplash, bruises from seatbelt. I've had a few flashbacks of the crash already making it tough to sleep. Very sore today. Need a new car now....loved that ride. Such a good car.
Wow! Good to see that you're okay. If you'd been driving an early 90's Jetta I don't think the outcome would have been as favorable. It really is amazing how far automotive safety has come even over the last ten years or so.

Glad you guys made it out with minor injuries. Let's hope the pre-existing issues weren't made worse over the long haul, and that you're made financially whole. Bad weather is the catalyst for so many events like this. How's the young person in the other car?

I saw that after I posted my reply. I assume X-rays, etc. were done.

I have learned a lot, the hard way, over the years. I especially learned a lot after an off duty fire fighter almost killed my youngest daughter when he made a left turn right in front of her.

If you want a private conversation, let me know.

Sprained wrist is all for that kiddo

Yes. PM me. I would like to be as educated as I can when dealing with the insurance crooks.

I’m glad that you guys came out of that as well as you did. Truly a testament to the safety of that car. As inconvenient as a wrecked car is, cars can be replaced, people can’t.
Hopefully you can get things settled up quickly and put this behind you.

Schedule a follow up visit to your primary care physician. See if you can get a referral to a specialist for further consultation. Get evaluated by a chiropractor (you don't have to have him adjust your spine if you don't want to). Take whatever prescriptions the doctors offer, even if you prefer not to take them. Do the physical therapy if prescribed (it actually helps).

Every bit of of medcal care you can show counts on your favor.

I am a physical therapist

I was in a crash half as bad. I crashed head on into a left turner going about 35 mph. I bear a scar on my chest where the airbag cover scraped my skin off. Not a good experience, accidents. I hope you both have a speedy recovery.

Glad you guys are okay! Seems like there was quite a few accidents then too. I had a near miss on 94 myself. Just glad I had a good set of tires (Defenders) and some still to avoid it. I agree with most everyone to get double checked just to make sure nothing was missed or did not show up the first time.

Roads were pretty rough today too. Just glad I was not out in them!

Firstly, I had a driver plow into my daughter and her friend a few years ago when they were broken down in the breakdown lane. My wife was met them there as it was near by and just walking back to the car when it was hit just after the drivers door. The guy was Drunk. A Massachusetts state trooper and the tow guy were there. Another 30 feet either way and one of them would be dead Period. Everyone was fine so no hospital. Our insurance company did the minimum for us and the other insurance company did the minimum for us and in the end cost us a ton of time and cost us a lot of money. What happened to the drunk driver? No one could or would tell us. We had to track down the police report, send it to the other drivers insurance company. A Nightmare. If I had to do it again I would check in with the emergency room even if we felt ok. (the next day everyone in the hit car was sore.) contact an attorney and have him run his methods and make sure this man looses his license for the maximum term. This wasn't just a DUI, someone almost died. Attorneys normally take 33% in my experience but it wouldn't be about the money for me. Glad everyone is ok. YES, the automobile manufacturers make good cars today. There is a video out there that shows a 57 Chevy in almost perfect condition go head on with a newer model Chevy car (if memory serves me right). Take a guess on which one did better in the test and how the occupants faired.

1 third 2 thirds is standard here. 33% to attorney, 66% to victim
The attorneys are still going to charge all of their expenses to the victim's part of the settlement. These expenses can be pretty substantial. In many cases the victim is lucky to get half.

Yep. It’s rare to have an attorney take 1/3, especially on a more complex case. 40-50% is becoming the norm.
