Insurance claim question, who's at fault?

I do know of someone with an old blue Corolla. Doubt he's in California though.

The driver must not show that to their insurance company! Who is ever going to insure someone who stops and backs up on a freeway?

As for "who's at fault?", this seems to be one of the rare cases where a 50/50 call is fair. It appears that neither one used their turn signal or was looking and tried to turn away before the crash.

To me it looked like the car that got hit was trying to swerve away to avoid the collision as much as possible in their own lane.

She gives her version of events to the insurance claim adjuster and that's pretty much the end of it. The insurance takes it from there....
