Yes i did get the oil. I did as you say several times previously but this time I'm sick and tired of paying
as that allows them to continue screwing people. If possible I'd rather have them have to pump it out.
I don't want a free ride but when will they get the message not to dump oil.

I tried to find a lock for the fill cap. No luck yet, but I will fabricate my own and that way they wont be able
to pull this stunt again. I'm not their customer and don't want to be and at this point I'm beyond disgusted.


I don't blame you. Not a chance in h*ll I'd be paying for it either.

As an aside, just be careful dealing with these guys and watch they don't come back and pour sand, salt, sugar or some other substance in your tank. With morons like these guys, they are capable of doing anything, imo.

Which is why I was suggesting he just pay what they have to pay to get the oil from the terminal/refinery.

I wouldn't want them to come back out and touch my tank.

Why not see if he can make a sweet deal. He pays the WHOLESALE price for the oil they delivered and maybe they'll learn not to come back.

Aggravation is worth something and they might just think cutting their losses today beats paying a lawyer $300/hr or selling the bill to a collector for 10 cents on the dollar.

That's why I would offer to pay the wholesale price, or what it costs them to get it from the fuel rack. It's that or nothing as he certainly didn't order the oil or have a contract since got the letter some time back.

It's a solution I could sleep at night with. Paying a discounted price for the heating oil he didn't order and closing out the matter.

Sure, it would be great to get it for free. I'm not sure that's reasonable.

If lawyers get involved, things get expensive.

Maybe just call them and say I didn't order it, and ask how they would like to resolve it. It doesn't cost anything to listen. They might even come up with a great solution. Just make it clear that any solution cannot include any obligation to buy in the future.
 
I prebought and got burned of $1000. Two years ago Oil karma came back when an oil company delivered 175 gallons of oil I did not request. Never got billed.

Not always. I filed a BBB complaint once against a car dealership who refused to return my $500 deposit on a mis-represented car. A few months later they did pay up.....and only because they had a black stain on their BBB account. If the company are not total crooks they will care what their BBB account says about....because people do sometimes those when looking for a dealer to service them. Who wants to pick someone with a C, D, or F rating? Any time I've filed a complaint the BBB has at least investigated it and make a decision on it.

Check the original contract to make sure there is no clause stating you must send a registered letter to cancel the contract. Once you've eliminated that question, I would sit and wait as the ball is in their court. I would refuse to pay because you didn't request the oil. Let them him holler and threaten and hang up on them until they offer a really, really good deal. Let them go to court if they are insistent on full payment, or you could be nasty and offer to pay $10 per month to pay off the amount. Ed
 
Dumping about 5 gallons of your used motor oil in front of their business, followed by an anonymous tip of an oil spill, probably would cause a lot more grief than anything else, but, a $20 locking cap is what I'd buy, and get on with my life. It's short.

Unusual these days.
I did contact them yesterday via email as I sent them all of the documents and
the expired contract from years earlier and the other emails between us over the other incidents.

I didn't expect a reply yet but when I do get one I will update you all.
The call center was closed for the holiday.

They took a few days and tried this absolutely dishonest response.
I have all the emails and certified letter correspondence that proves I was no longer a customer and responses from them
stating such.

Good morning,
I have reviewed your account and it appears you conversed with my Sales Dept., after our communications, after I updated your delivery status to will call on 12-6.
Records indicate automatic delivery was put back in place with a new Fixed Price Agreement on 12/6/17 the same day.
The delivery was generated by our computer because the tank remained on automatic delivery as per the Fixed Price Agreement.
I am allowing my Sales Dept., a copy of your email to review and Sales will be in contact with you to discuss.

Makes no sense. Just a stupid dodge attempt.

I'd like to see the signed contract. It isn't verbal but written and requires a signature.
 
My mom has an old house in upstate NY. It had oil heat. After two years of messing with it and getting ripped off my local providers, and spent a few grand having a gas line ran, and natural gas furnace installed.

House is warmer, and her bill is less than half of oil heat cost.
