Having Issues with Insurance after Wreck

As duckryder just confirmed you do you live in a no-fault state. So good luck getting the other drivers insurance to pay anything that's not how a no fault state works. This is all on your insurance. If you don't have any sort of add-on like I posted before on your insurance you will be on the hook for your deductible.

I am surprised that your insurance didn't jump on it as this was not your fault . I I guess I do kind of understand as they're not going to get an insurance premium rate hike out of you so why bother working fast.

My wife's car got rear ended and pushed into another car and Progressive was great. Unfortunately she shared her number with the driver she bumped in front who called me before she told me about accident insisting I personally get him a rental and pay damages. I said cool your jets buddy and gave him progressive's number and my policy and added him to blocked number.

Progressive crushed the little man on the phone she rear ended damaging his exhaust(loud apparently). They only said get the insurance info from the person/police who rear ended wife and Progressive took no responsibility in accident. He left voicemail to me on how Progressive was "mean". The rear ender was a hit and run but left imprint of license plate in wife's bumper which I passed onto my insurance I collected from who chased the run away driver insurance.

I hate to say it but after this type of treatment, does your fiance's neck hurt at all? Having been rear-ended, she is completely in the driver's seat here.

Like CKN said above, even without the other driver's cooperation at this point, the fiance's insurance carrier is legally obligated to deal with this for you. Of course the more budget carriers like progressive are going to try to push back initially, you just have to be more creative/assertive on the phone.
 
Many moons ago I got tagged by someone, police cited them. They showed some kind of insurance card to the cop. When I finally tracked down the hole-in-the-wall company he had, they were very uncooperative and said "we don't have anybody by that name" . I thought I was in good hands with my agent (ha), but he wouldn't do anything unless I forked over a deductible and started the claim with him. After some pleading and prodding he reluctantly called and got the same runaround from the other company. I already had an estimate, it wasn't even up to my deductible. I called his company once more, finally got a little more cooperation from them and determined that neither he nor his wife were clients, and they didn't have anybody with that make and model of car even remotely resembling their names. Finally sent a friendly letter by registered mail to the guy, mentioning that his company said they don't have anybody with his name. He got VERY cooperative and paid cash for my repairs and a rental car. I suspect he dropped his coverage and didn't want the police involved.

I went with a different insurance company not too long after that, for lots of reasons including my agent was kind of a jerk to deal with.

Last time I got tagged and it was the other guy's fault, I went to their carrier directly. They were very helpful, but pointed out they had to get in touch with their client first to get their side of the story too and to get the police report.
 
Be certain that she has a complete checkup from a doctor asap. If there is any neck pain it must be noted immediately.
 
If this ever happen again, while you are with the other party, tell them to call a claim to their insurance while you are there.
Get that claim no. from them and use that when calling your claim.
This way, the insurance company does not have to wait for the guilty party to confirm the accident.
 
This situation is why I always use a local agent. May or may not pay more but it's hard for them to play this game when you're looking at them across their desk. Hope you get it worked out OP.

Yeah. Even your own insurance company should let you pay for a rental at the insurance companies rate. You just need to ask them how to get that. Yes, I have done this.

This. I have had this issue where they wouldn't do anything until they talked to their client. So I gave their I insurance company their cellphone number, which they didn't have and after that it went quickly.

She shoulda stepped out of the car clenching her back, laid down on the ground yelling, OH MY BACK, then asked for an ambulance. That would have got the insurance companies attention.

This was 20+ years ago but a guy hit me (turned left in front of me) while on his way to FL for vacation. It was a Friday evening when this happened. My car wasn't driveable so I had to get a rental. I called his insurance and he hadn't reported it yet so they wouldn't help but did tell me I could pay for the rental and then they'd reimburse me once they got the claim. That son of a female dog waited until they got back from their 2-week vacation and then until the Monday (17 days ??) to report the claim !! Then the insurance denied my rental car saying they didn't authorize it. I was young and naive then..... That will never happen again, I can assure you !
 
I'm going through sort of the same thing right now. Wreck happened on 7/5 (video in dash cam thread if interested), their insurance is State Farm and gave me the whole we need a statement from our insured BS. She called today and reported and just after lunch I spoke with one of their claim specialists and all that was left was to verify my insurance (Louisiana is a no pay, no play state). I can't imagine it takes that long to verify insurance but I am yet to hear back from them. My insurance, Allstate, would be happy to step in and recoup their costs from State Farm but I'm apprehensive about taking that route because I don't want it to somehow affect my deductible. This is one heck of an experience I'll tell you that. I already have a sour taste in my mouth. Good luck OP, I hope you get your situation sorted.

This is what can happen when you insure with a budget insurance company like Progressive. Funny ads, but not a good company and you have no local agent to lean on. Progressive must realize that the only way it could be your fault is if your wife was driving in REVERSE. Is $130 a day for a rental a typo error? I hope so.

Take charge with the Progressive dopes and eat you deductible until the claim is adjudicated. Maybe get your local Nissan dealer to inspect the car and give you a written opinion on the safety of driving the car as damaged. Just do the normal cover your butt things and rent a similar class car, not a luxury model. Things will get sorted out.
 
130$ a day is nuts

go to Hurts rent a car

it's $59 with full coverage or $29 without the additional insurance (make sure to add it to your policy since you will be driving it a while)


it's totaled For sure

lamo most cars can go 45-50MPH in reverse with a standard or automatic trasmssion (NOT a CVT)

but the nissan has a very very weak CVT transmission(except for the 2009-2013 hybrid altimas they used a Toyota Hybrid Synergy Drive E-CVT) it would probably blow it self apart before getting to 20mph



you will need to lawyer up this time .. sorry you will get nowhere without

Not necessarily; my independent agent shops new rates every couple of years and this year the best deal was using different companies for homeowners and auto policies.
 
Update! Thursday the 11th (8 days after accident) travelers is going to send an insurance adjuster to the house to determine if the car is driveable and estimate damage. They still are refusing a rental car.

I can't find anything locally with availability for under $130. Everything seems to be booked. Usually I managed to get some sort of rental for vacations and whatnot for like $20 a day. Rent-a-wreck type places.

Progressive is actually trying to be helpful. They offered rental reimbursement (and to go after the other ins. company) if we pay the deductible. I'm hesitant to go that path because I don't want unauthorized work, etc, whatever gives Travelers a reason to back out. Or increased premiums. The first day the claims rep we spoke to wasn't too helpful, but I'm guessing she had plans for 4th of july and wanted out of the office.

20040 miles and it already has the death whine that Nissan CVTs get before they experience catastrophic failure.
 
From what I've heard through friends and colleagues, there are a lot of lawyers out there willing to take up cases like this because it's a slamdunk. I would suggest you call one regardless of what the insurance company say, your time and headache is worth some money and there is no way I would pay for a rental car when you are not at fault. Let the insurance company deal with the lawyer and pay his or her fees, it will get the ball rolling much quicker and less games in my opinion.
 
Miller88, that car is totaled.

My aunt's 16' Avalon wasn't quite as bad when it was rear-ended and it was about $10k to fix. That'll probably total a Sentra since the damage is even more.
 
Only a fool would deem that drivable. Yeah... it'll drive, but what happens when it rains and the trunk fills with water?
