Dieselgate Part 2?

Not really. DIeselgate and this are two different things from the get-go. This is arguing that authorities knew and allowed certain software that this group finds problematic.

CARB and EPA did not know anything. There was a two-stage process in the dieselgate:
1. CARB and EPA did not know anything. A group of students discovered cheating.
2. CARB and EPA approached VW, and then they lied to them and tried to hide it and get away.

None of that is present here. The problematic party here is KBA, apparently.
 
First this is a case against a govt agency. Think Greenpeace suing the EPA.

Second without knowing the specifics of the operational parameters for EGR utilization it's hard to tell exactly what the plaintiff is suing the over and how those parameters are interpreted by German law. This is in addition to any post-Dieselgate agreements between VW et al and regulators.

Here is your problem:

The European Court of Justice last November backed the rights of environmental associations to take such actions against EU vehicle approvals on the basis of DUH's lawsuit, which was initially rejected by the Schleswig administrative court in 2017.

Legally the DHU is not more than your local boy scouts club - but the EU gave them the power to destroy whole industries.
 
Sounds like the EPA here. Non-elected officials deciding requirements for industries here in the US.

Sierra Club is a close second to DUH here in Las Vegas. They sued to prevent highway improvements and caused years of traffic jams with their obstructionist behavior. They are responsible for miles and miles of expensive and mostly unused carpool lanes. May they all suffer a plague of locusts.

Umm. No it's not, That's how government operates in Bureaucracy or a Kleptocracy, where important decisions are made by unelected, and frequently unqualified, individuals who are often acting in self-interest or at the behest of special interest groups.

In a Representative Democracy, important decisions are made by elected officials who act in the best interest of their constituents. Elected officials have some degree of accountability to the voters. Bureaucrats - Nope None.

From my point of view, VW was harshly punished for making the most efficient automotive engine ever made.
Yeah, Let's ignore that they lied about how bad their emissions where, just to make more money, b/c they coudn't figure out how to make an efficient engine that met the USA EPA requirements.

Emitting extra cancerous causing emissions to the folks that bought these cars, & others, under the advertisement from VW that they were "Green diesel's & met the strict epa standards".

Real fine engineering their VW. :rolleyes:

My point avoided the ethics of the situation, and I would like to continue avoiding the ethics of it.

These VW diesels were said to be (with regard to NOx) as much as 35x (or even 40x) worse on the road, than when performing the test. However, it is good to remember that 35x more of near nil NOx puts the car's at the compliance limit, and a few examples exceeded the limit by 2x. Hardly a disaster when considering that NOx is created in stunningly huge quantities by lightning storms. NOx is a contributor to air quality issues in some areas, of that there is no question. In other areas, it is pretty much a non issue.

And what do Lightning Storms cause?

Fires... & you know how much emissions they put off.

Trying to minimize the damaging affects of nature to ok a man made polluter is no two rights. The ethics are a real equation to the story. It damaged a lot of people & nature. This should not be swept under the rug.

That being said, I hope VW succeeds in the fact they've learned a hard lesson & provide accurate, truthfully, great engineering products for the consumer to buy with 100% confidence. I'm excited about their electrification future which they see as their path forward.

VW knew how to do it but it was too expensive for the segment in which they sold their cars.

Let me provide you with a dose of reality. Politicians routinely pass the buck onto the bureaucracy or the courts for their own failings. Since voters are generally ignorant of this they let themselves succumb to tribalism and consequently vote against X by voting for Y. This creates an insidious cycle which insures the survival of the incumbent and keeps the campaign money flowing.
