Assume it's not rated for that HP?
Did buyer know that it probably wasn't as claimed but bought it based on being bigger than others being sold on the market for the money? Anyways, this is all too much for the section on my part. I suppose in the humor section questions remain unanswered.

I have watched a bunch of youtube's on these outboard engines from China (and diesel engines from China, and plastic boats from China) Seems like some of the small ones are pretty good, but have some assembly issues that need correcting to make work right - sort of like Chonda generators.

40HP is pretty funny though.
