They kind of are. They are making the Navy choose between being crucified at home (prosecuting) and being crucified abroad (dropping the charges).

The only reason they are going abroad is to face their accuser, the suspect in custody who claims he was abused by these men.
They will still be tried by the US Military, not the Iraqis. It will just be a facility in Iraq, not the US.
I'd rather have that than to bring the terror suspect to the US for his charges against the SEALs.
