HTC files to ban U.S. iPhone, iPad, iPod sales

HTC Corp said on Wednesday it filed a patent infringement case against Apple Inc and asked the U.S. International Trade Commission to ban U.S. sales of iPhones, iPads and iPods.

The case is a response to a patent infringement lawsuit that Apple filed in March against smaller rival HTC, a maker of phones based on Google Inc's Android software, which has gained a lot of ground on Apple's popular iPhone.

Taiwan's HTC accused Apple of infringing five HTC patents and asked for a ban on importation and sale of the its popular mobile devices in the United States. Apple, which has its products made in countries such as China, declined comment.

HTC, which was fourth in the global smartphones market in the first quarter, just behind Apple, did not give details on the patents in question in its statement.

While Apple's lawsuit against HTC did not name Google as a defendant, analysts viewed it as a proxy for an attack on Google, which also provides software to phone makers including Samsung Electronics and Motorola Inc.

HTC's move to countersue Apple was expected, but the larger question is about HTC's patent portfolio, which doesn't measure up to other smartphone makers, such as Nokia, said MKM Partners analyst Tero Kuittinen.

"I think it's widely acknowledged that HTC's IP portfolio is not particularly strong, because they got started on this way later than they other guys," he said.

The ITC, a U.S. trade panel that investigates patent infringement involving imported goods, has become a popular venue for patent lawsuits because it can bar the importation of products that infringe on patents.

The ITC confirmed that the lawsuit was filed, but had yet to put a digital copy on its website at 2:30 pm ET (6:30 pm GMT).

"We are taking this action against Apple to protect our intellectual property, our industry partners, and most importantly, our customers that use HTC phones," said Jason Mackenzie, HTC's vice president for North America.

HTC also makes phones based on Microsoft Corp software.

Apple shares rose 2 percent to $261.85 on the Nasdaq stock market.

Ban? I thought you were innocent until proven guilty in this country.

Let's see who wins this. Apple has very deep pockets so they probably will win.
 
I don't think there is much to ban on. The only thing I can think of that may have a problem is multi-touch, but that is something that Google is going to come in and wrestle with Apple on.

I'd imagine HTC is not going to have a problem given its new Android phone is very good, and very popular, that carriers will not just drop it. If HTC gang up with Motorola, Nokia, RIM, etc, Apple is going to be in more trouble than it is asking for.

I'd love competition, even when I work for the evil guy, because that keeps demand of employees high and salary high. The last thing you want is to work for a slave driver that said take it or leave it.

Prior art. They got this from another component vendor, I think it is LiteOn. In the worst case? Just get an additional sensor to turn off the phone, big deal.

Prior art, everyone that does communication do this better than Apple for years. If anything it is Apple who got sued rather than HTC.

Prior art / obvious idea: event notification is in every single OS since the dinosaur days of older system like UNIX. You put it in a GUI but that doesn't means you can get a patent for that.




In reality it is Google vs Apple and see how well it will do. I'd be surprise if Google isn't lending a whole army of patent lawyer to HTC for free to fight this off.
 
I don't think much of HTC's products or even Samsung's. I don't really like any Korean products. I tend to stick with Motorola and Sony.

There is no crime committed. This is a civil matter.

Well, I've got the newest HTC Android Incredible and love it. Got tired of my Windows Mobile smartphone locking up and crashing just like all of Bill Gate's other operating system junk.
