Got an odd "parking violation"

Came out to my rental car after work (garage is in our office building) to find a "parking violation" stuck to the windshield that accused me of "other", which in this case was speeding (18mph). The "violation" is not from the city or state, and appears to be from the garage itself. There is nothing on there telling me that I'm going to get a ticket, that the police were notified, etc. There is a tear-off section from the bottom that was removed.

My first instinct was that this is just some unenforceable warning, but I did find the following in the motor vehicle laws:


Sec. 545.351. MAXIMUM SPEED REQUIREMENT. (a) An operator may not drive at a speed greater than is reasonable and prudent under the circumstances then existing.
(b) An operator:
(1) may not drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard for actual and potential hazards then existing; and
(2) shall control the speed of the vehicle as necessary to avoid colliding with another person or vehicle that is on or entering the highway in compliance with law and the duty of each person to use due care.



Sec. 545.401. RECKLESS DRIVING; OFFENSE. (a) A person commits an offense if the person drives a vehicle in wilful or wanton disregard for the safety of persons or property.
(b) An offense under this section is a misdemeanor punishable by:
(1) a fine not to exceed $200;
(2) confinement in county jail for not more than 30 days; or
(3) both the fine and the confinement.
(c) Notwithstanding Section 542.001, this section applies to:
(1) a private access way or parking area provided for a client or patron by a business, other than a private residential property or the property of a garage or parking lot for which a charge is made for the storing or parking of motor vehicles; and
(2) a highway or other public place.



So if I read this correctly, you can be ticketed for speeding if the officer believes it was too fast for conditions, and you can be ticketed for reckless driving in a parking structure UNLESS it costs money to park there (our garage does charge).

But since my supposed speeding wasn't observed by a police officer, isn't it reasonable to assume that this parking garage can't/won't do anything? I know that if you receive a ticket while in a rental car it is very difficult to contest since the rental car company will always pay it on your behalf (thereby entering a plea of guilty) and you have no way to contest it.

I got a similar "ticket" after parking in an unattended lot. It had a big metal box with tiny numbered slots to force cash into.

First of all, I pulled into a space that another car had been parked in. I assumed he had paid but went ahead and folded up 3 singles and stuffed them down into the slot with the number of the space I was parked in.

Came back out and I had a "ticket" for non-payment.

I threw the "ticket" with all the threatening legalese away.
 
Mine doesn't even have any legalese on it. Nothing like "we've informed the local police" or "your speeding was in violation of the following statutes" or whatever. There's no actionable item on it.

It had the garage's name stamped on it, and I actually saw another vehicle in the garage with the same paper stuck to its window.

There were boxes they could check for stuff like parking in a space that isn't yours, blocking a driveway, etc. They checked "other" and wrote in "speeding: 18mph".

I would only call it that if they tried to intimidate you into giving them money.
 
I would ask the garage..the fact they gave you that while it was parked is sketchy..i would ask the garage..tell them the story..see what they say
 
Interesting!

Perhaps they're just trying to get people to 'slow down' in their parking garage. Are there speed limit signs posted? Sounds to me like they can't really do much.

But hey, that's a first...
 
I've gotten a similar parking lot warning saying they had my vehicle information blah blah blah. They never did anything. I park in that lot all the time. If it's not from the cops, ignore it.

Actual cops (not meter maids) in my area don't seem to care that much about parking lot violations. I've actually had a cop give me a blank ticket for show and tell me to throw it away after I left the parking lot.
 
The worst they can do is keep your license plate on file, and tow you from their lot if you park on their property in the future.
 
I would call them up, ask for the serial number and type of speed measuring device and the date of it's last calibration. also the certification of the speed measuring devices operator.

In Florida, you have to be certified (I am) to operate RADAR, LIDAR, stopwatch, etc.) The devices have to be certified every 6 months, no exception.

I would not worry about a private "ticket". Too easy to get tossed in traffic court.

I'd track down that want to be cop and ask him just how he came up with 18 mph. Radar gun? Then ask him what orifice he would like said ticket.

Maybe the mall guard paced him on his Segway!
