Former employer screwed me

So I've been trying to get hired into this big company for many years now. I've been close a few times, but they always change their mind at the last minute. I finally found out yesterday that they recieved an "unfavorable" reference from a former employer. I know exactly who it is, but they won't give me any more info as far as what was said. How can I find out?
 
Get a friend to call this person you think gave you the unfavorable reference pretending to be from Human Resources of _______ company and have them ask if Mr Rat (you) is a good employee, your work ethic, training , qualifications, etc.....etc.

This person will then say that Mr Rat (you) is a lazy bum that should be flipping burgers and not be hired by ________ company you applied for. Of course you will be listening on the other end to hear what they say.

If this person said something negative about you in the past, I'm pretty sure this person will talk more trash when another company HR Dept calls asking about you.

I do plan to play this game, but is there any way legally I can find out what was said to the potential employer?

Usually former employers will just issue a "no comment". It says the same thing as a negative comment without any legal liability.


That's exactly what we do where I work. We verify time of employment and position held but no comment on performance. Anyone checking references knows exactly what this means.

Just be sure your ex-employer doesn't have call display...

if a negative reference was given, legally you could sue. in this great depression II, you can't be without a job.
 
Most HR departments when called will confirm your employment.

Dates, position held and the biggest thing,

Is he eligible for rehire?

If they answer that with an NO the call ends and so does your chance with the new company unless they ask YOU what is going on.

Pretty well anything else will get an HR department into some serious trouble.

Ask yourself this: What do you intend to do once you find out?

You can sue their collective patooties into retirement if all your reviews were good.....personally I keep copies of all my reviews.

Some advice I learned long, long ago: The HR department is NOT your friend.
 
If your old company is degrading you or saying anything besides "He worked for us from this date until this date",it`s illegal and I suggest that you take legal action against these scumbags.

+1 and TRUE! It would be stupid for a HR rep to comment on why they feel this towards an ex-employee... But IF what they were saying is true its a non issue as far as a suit.

Burning bridges when you get a new job is not a good thing. It does come back if you did so....

The HR department is not composed of employees of the company. They're more like the Gestapo or CIA. Nobody rules over them, not the CEO or President and company rules and restrictions seldom apply to the HR department. This is particularly true when salary freezes are imposed.

And thats the thing, I was never asked about it. It was an accusation of theft, (I was one of many accused) and I was proven innocent after an investigation. This guy seems to be holding a grudge because I fought back when I was wrongly accused.
