Ebay issue,

I purchased a pair of work pants on Ebay. The add listed them as "New without tags". Now, I didn't expect them to be pristine, as I'm skeptical of anything sold with that description, but I expected something in good enough shape that I could actually wear them to work.

The pants I received are obviously worn, with frayed seams and a musty smell, like they got wet and soured.

Not pleased. First step is complaining to seller, next to notify Ebay that item is not described and I am not satisfied?

I think I would shop salvation army before buying anything except new clothes on ebay (from a manufacturer).

I wouldnt accept anything less than a full refund including shipping on some obviously bogus clothing

Try to resolve it with them if not paypal can return your money, be sure to leave feedback so others will know.

I do, I'm just an odd size. I went to 3 thrift stores first and couldn't find my size. And my goal is to get a full refund. I might have paid a few bucks at Salvation Army for these and worn them for a few days just to get by, but I'm not paying $20 for clothing in this condition.

Mail that guy a turdbird! I like the ebay concept, but never for clothing, shoes, underwear, or used wives/girlfriend. Sometimes trying stuff on before is just better and apparently less musty smelling. Good luck!

That is one reason why I have not bought stuff on Ebay over the last 5 years. Too many scam artists selling on there. What was their feedback like prior to your purchase?

I would take the position that you are still waiting for your new-without-tags item to arrive in the mail. Having not gotten it, you'll be yanking all your money back thru paypal.

USPS regs state that if you get something you didn't order, you can consider it a gift.

If they want the wrong thing back, they can send you postage.

The typical ebay scamster will sell a $2 item with $20 shipping and offer you your money back minus shipping. Don't bother.

Always scrutinize the seller`s feedback before buying/bidding. I bought a Ralph Lauren button down lot (the ones that sell at Dillards for $100 a piece) on Ebay one time,new with tags,still in sealed plastic bags,and untouched. I think there were 20 of them and I only paid $25 or so for the lot. Seller had 100% positive feedback.

Only time I`ve ever been gyped on Ebay was when I didn`t look at the feedback prior. My fault for not doing that. Luckily the puchases were only like five bucks or so,no biggie.

The seller has a 100% rating with about 70 feedback. This is my first negative experience thus far.

Also my first experience buying clothes on Ebay. I'm normally a thrift shipper for most clothing, as I find most retail prices outrageous. But due to having my hours cut at work and my wife's employment having become less secure, buying everything possible for as little as possible is especially the way of the world right now.

Amen to that one! ONLY time I buy clothes is when they`re on uber-clearance!

#1: Complain to the seller that you're not happy with these "new" pants and that you want to return them for a refund. If they don't play along, a simple case opened from your end will resolve the issue within a week or two (escalating it, if the seller still refuses to take the item back).

Be sure to take QUALITY, CLOSE UP pictures of the item / wear marks and upload them into the case details, so the ebay rep can see what you're seeing and close the case in your favor.

I've been purchasing / seeing on ebay for over 14 years now and have 730 posted feedbacks (1,000+ transactions though) and although I've seen my share of bad sellers / buyers, my overall experience on ebay is very good and I try to purchase whatever I need from ebay first (if the price is the same) in order to support the little guy vs a huge corporation like Walmart, etc. If there are multiple listings for the same item but one seller has 20,000 positive feedbacks (and 100s of negatives) but another has 500 positives, I'll purchase from the second guy, if he has a nicely setup listing / description like he put some effort into it.

Not sure where you've seen this but ebay's return policy states that you ship the item back at your expense and that you'll get the original purchase price back AS WELL AS the original shipping cost, so in that situation, you'll get your $22 bucks back from the seller.

Ebay has informed me that the seller has offered a full refund, but I pay return shipping.

Not sure why the return shipping should be my concern, it's not my fault I didn't get what was described.

Ebay requires a tracking number for a return to seller.

After a ton of happy Ebay purchases, this is putting me off.

Don't settle for that. Hopefully you paid via credit card so you can dispute the charge. There's NO way you should have to pay return shipping due to the seller's negligence by trying to rip you off and sell you what you did not pay for. You paid for a new pair of pants,not a used worn out pair of pants.

I paid via Paypal.

Just uncertain how to proceed with Ebay, as I got the message from their Resolution Center and not directly from the seller. Finding a "I do not accept this offer" option would be nice.

Did you pay with Paypal via credit card? That's the only way I'll do it. I never use direct bank transfers. Gotta keep yourself covered 200% just in case.

The return shipping falls on the buyer if you're not satisfied with your purchase. Ebay doesn't have a policy in place in an event where the seller is at fault, so in a sense, the system is flawed in this case.

Give ebay a call and see what your options are but I'm pretty certain they will say the same thing... You have to ship the item back at your expense. Lucky for you, it's not a lot. I've shipped back huge 80LB packages where I dished out $120 in return shipping because there was simply no other choice and I definitely wanted my $3,000 back for the item.

Now if you're not satisfied just because you decided you don't want the goods anymore,I can totally see paying to ship it back. But if the seller committed fraud and sold you something you didn't pay for,seller should assume all shipping/handling costs.

Yet another reason to pay with a credit card anytime you purchase goods sight unseen.

But if you do a charge back on your credit card that you used through Paypal to pay for an ebay purchase, ebay can close your account PERMANENTLY, from what I've heard.

I suggest the OP contacts ebay to see what can be done and then contact the seller as well for a return shipping label / funds.

It's a small risk that the buyer takes when purchasing anything online. You're either willing to take that risk or you're not.
