#1: Complain to the seller that you're not happy with these "new" pants and that you want to return them for a refund. If they don't play along, a simple case opened from your end will resolve the issue within a week or two (escalating it, if the seller still refuses to take the item back).
Be sure to take QUALITY, CLOSE UP pictures of the item / wear marks and upload them into the case details, so the ebay rep can see what you're seeing and close the case in your favor.
I've been purchasing / seeing on ebay for over 14 years now and have 730 posted feedbacks (1,000+ transactions though) and although I've seen my share of bad sellers / buyers, my overall experience on ebay is very good and I try to purchase whatever I need from ebay first (if the price is the same) in order to support the little guy vs a huge corporation like Walmart, etc. If there are multiple listings for the same item but one seller has 20,000 positive feedbacks (and 100s of negatives) but another has 500 positives, I'll purchase from the second guy, if he has a nicely setup listing / description like he put some effort into it.

Not sure where you've seen this but ebay's return policy states that you ship the item back at your expense and that you'll get the original purchase price back AS WELL AS the original shipping cost, so in that situation, you'll get your $22 bucks back from the seller.
