Advice on diminished value claim

2021 M2 Competition, 13k miles, MANUAL....PLUS it has $7k worth of FACTORY M Carbon Fiber - on the window/options sticker (not added after so its not "custom accessories"). Never seen another one with similar spec. It would cost close to $7k + labor to replicate it on another M2 without these parts.

Question -- today she was rear ended, generally minor damage but it needs a new rear bumper. I want to chase for diminished value because I have definitely lost value, and I may be forced to sell her in the coming months with another child impending. So this isnt just a grab - I was getting ready to prep for sale so this is unfortunately terrible timing.

1) Not a single 2021 M2 in the entire USA right now for sale has the carbon fiber front bumper, spoiler, mirror caps, Alcantara trim, rear diffuser, splitter and side grills together as one package. Theres a few with maybe a few of these 1-2, but none in total (the original owner was a maniac and just basically checked ALL the factory boxes on a German order build)

2) Manuals are going the way of the dinosaur...

Whats the strategy I should take here if anyone has gone through this before? I feel like looking at clean title vs damaged, its at minimum 5k difference, some as wide as 10k. How should I prepare to make the diminished value claim?

In CA you can file a diminished value claim with the at-fault driver's insurance. You need written proof, appraisal, etc.
Sounds like the car was repaired correctly, so you only have the record of an accident as a possible loss.
Everything is negotiable... Did you talk to your agent?

What insurer is paying the DV? Got my FIL $3,500 on a 2019 AMG GT bumper repair and refinish woot hoot any trouble at all.

Everything you listed is meaningless in this claim.
maybe that’s true…So i just accept I get screwed over by no fault of my own even though the cars worth less now?

No repair yet - this just happened today. I’ve filed a claim with their insurer.
 
I have never used the service, but I see at times posts from folks who've used this outfit to pursue diminished value or better total loss values when the insurance company low-balls them. Especially on old domestic trucks that every insurance company thinks are worth pennies, when clean and well-maintained specimens are hard to find.

Your car is 100x nicer than an old American truck, so no doubt it is worth pursing. Really pretty car.
 
You have to check your state laws. Some states specifically support DV (like SC), and some states specifically deny it. So I could tell you about it here, but it would do you no good.

Once you figure out your state laws you will have a better idea how to proceed.
 
Can you post some pictures of the damage?

As I mentioned it’s minor but the plastics warped/rippled and entire bumper needs replacing plus possibly that parking sensor.

Arizona permits DV claims. Just never done it…only one other vehicle accident in 20yrs of driving and it was totaled by the red light runner so it was straight forward.

I wish you luck with your case. Despite my best efforts, negotiations, lawyer etc, Allstate paid me just over half the real world value of my totaled truck. Insurance companies are stunningly good at non payment. The insurance company may even tell you to pursue a lawsuit against the guilty party.

Beautiful car. I suggest keeping it. There are fewer and fewer 'Drivers Cars' around. It won't be long when zero fun cars exist.

Completely off topic, but I was trying to get around a Tesla yesterday. It was self driving, and it used every trick in the book to prevent me from getting in front of it. Matching my varying speed, slow rolling along side me, zooming up to close a gap, changing lanes rapidly and more. My point, today's vehicles are computer oriented, not driver oriented. And yes, the computer was able to out-drive me.
 
I’d wait til State Farm has had a chance to look at it for the damage and then bring it up to the adjuster. They don’t just offer these DV payments up without you asking. If you can put together some talking points, you may be surprised. It might take til you go to sell it in January and the dealer or buyer says “oh the carfax shows an accident, it’s going to be worth $x,xxx less” to provide that as proof to State Farm.
 
Do you guys believe the plastic is irreparable? If it were metal obviously PDR would probably do it, but since its warped, I assume this is a replacement only job?

Very easy to feel with my hand its all lumpy from being pushed in. I also dont know if the parking sensor bracket might be broken since its completely inside the bumper. I wouldnt want this to be a hack job to fix...

I can come back that long after this is all repaired and make a claim then? I would have figured this would be all part of the "case" i.e. They fix the car in full, then I hit them with a DV claim. I'm not unreasonable here making a claim that this is 10k. I would expect on a quick view from BAT and Cars.com (which have VERY few examples to start with, and ZERO with my spec...) that I've basically got screwed out of 3-5k here due to this.

The idiot just thought I made a right hand turn already and just accelerated rather than ya know, looking forward.
I have dash cam video of it (finally paying off...) so the accident is undeniable

If what you're saying about the title is true, I would self pay and do as little as possible.

Re-mount the sensor, replace the foam under the bumper cover, and try to ignore the slight wobbles in the bumper cover.
 
My thoughts on this. Selling the car as-is might be better for you than repairing it and having the carfax show accident. You'll have to figure out those numbers. For DV, you'll have to be able to prove the market value of the car before and after the accident/repair. They usually do that through comparisons to other similar vehicles and their selling price. Since you say that yours is one of a kind, it's difficult to know what the true market value would have been in pristine condition. I don't know how valuable the carbon fiber upgrades are to a potential buyer.
 
If you're looking for a place to repair the bumper take a visit to Ultimate Auto Touch-Ups in Chandler, Cameron the owner started out in-house at the BMW dealership there and has done repairs for me as well.
