What Is Going On Here

I had an accident back in December and the driver that hit me did not have insurance.

In January I mailed a Uninsured Motorists Claim Form to the Maryland MVA.

I got a response back today that this person turned in there tags on January 15th of 2009.

This accident happened on December 8th of 2008

They said that since the vehicle is no longer registered in Maryland that they cannot go after him unless I take him to court and the only thing I could do is go after him for the $250.00 deductible that I had to pay on my unisured motorist coverage.

The repair bill was $3100.00 plus $400.00 for the rental, my insurance company is not going to go after him.

Why did he return his tags, I have my old tags from a car I had for 2 years in the 1980's. When my insurance requested a proof of insurance and found that he didn't have insurance, did the MVA send the guy a FR-19 form, which is a proof of insurance form.

Even my Dad has his old tags from every vehicle that he has owned, did the MVA say look you have no insurance, turn in the plates.

His car had some front end damage and he was able to drive away, any thoughts, do I take this guy to court or what.

Talk with the Manager of the branch. Most people that work at the MVA do not know what they are talking about or really care about their job very much.

The tags only need be turned in if the vehicle is still registered and not insured. If the registration expires ..you can recycle them ..frame them ...make neat neo-urban art work out of them.

Anything you want.

It's only when you're registered and not insured that you get the notice to turn in your tags. Registration is for a year. Insurance is typically a 6 month gig.

Prob be wasting your time. If he can't afford insurance good luck getting your money.

$250 is probably not worth your time. In the end you will spend more effort on that than the equivalent of $250 (depending on the cost of your time).

I called the MVA and they said that if I got a judgement against this guy then he would not be able to get tags and registration and his license would be suspended until he payed up.

My only concern is that if he does not show up to court then I would have to pay a sheriff to go after him. I will find out if I can get a judgement with out him there, if not then I will probably forget about it.

The MVA said that MAIF which is the Maryland Automobile Insurance Fund, never notified them that he did not have insurance for 2 years.

If he tries to get insurance with another company are they going to see that he did not have insurance for 2 years and then not want to give him insurance.

HAAAAAAAAAAAAA! That sure doesn't stop people from driving uninsured here. Something like 30% of drivers in CO don't have insurance. Unfortunately, 90% of the 30% are illegals.

Uninsured motorist coverage bodily injury is mandatory in CO.

It is a law, but a person can buy a car, get registration and tags, then get the insurance.

They can drop the insurance and the only way that they can get caught is if they are pulled over.

You could technically drive a car for 10 to 15 years but you would have to get some stickers for the back license plate.
