VW Automatic Emergency Braking

A funny but terrifying thought in our litigious world; if you did accidentally strike a pedestrian jaywalking on a city street, could they then proceed to sue you for disabling this "safety" feature?
I’m not worried about what ifs. In that situation, you will be sued regardless.

In this day and age you can be sued for just about anything, so why not?

Ahh and this is why I like not having cars with extra safety features. I can't get in trouble for turning them off

I think my montero got 0/5 stars on the pedestrian crash test so I guess I better just be careful.
 
If there is a button to turn it off, why worry about law suits? Are people seriously so paranoid these days about lawsuits?

Besides, if someone successfully sued me for turning off the avoidance system, I’m pretty sure I could successfully turn it around and sue the manufacturer for allowing me to do so.

Good point, but who needs that hassle? It's a shame you can't opt out of the nonsense you don't want when buying a new car. Stop/Start comes to mind after the recent rental I had in Florida and playing around with it for a week, no thanks!!
 
Well apparently they are, if they think somehow someone would even find out they had turned it off in the first place.
I would guess if there is an airbag deployment the black box will have a telemetry and condition snapshot pre/post deployment.
Neither my car nor my wife's MT subaru have this stuff (thankfully?)

I wonder when the eco police will show up and cite me for disabling the auto start-stop function on my Ford :)
