Vehicle title question???????

OK, I bought a 2002 Corolla on July 1st and I still have no title!!!!!!!!! The car was financed by previous owner; I have a bill of sale saying the title is forthcoming. When I bought the car, the lady said she'd have it to me by that next Friday as she had to get it from the finance company after the lein is cleared. Didn't come; I called, she said she just got the title from Toyota bla bla bla, be here by today. No title. I called her and got rough; I wasn't an *******, just firm and she got all bent outa shape. She's giving me a song and dance. When I bought it, she initially said a check was already sent to clear the loan, insinuating that she didn't need the funds from the sale to pay off the car. She's given me 3 stories now. My dad's lawyer will call next if I don't get it within a week. My question is this: what is the normal process for buying a private party car that's been financed? I was under the impression that the finance company will relase the title directly to the new owner once the loan is paid etc. Am I out of line on this? I think 2 weeks with no frikkin title is a bunch of BS!!!! I can't register it; I can't even get full coverege insurance; insurance company needs to see the tile. Am I the ******* here? The lady sure thinks so

I don't understand how the title system works. But if you cannot insure this vehicle as per lack of title, then I can't see how you are being unreasonable.

Although I don't like to get lawyers involved (and I hope you don't have to), sometimes the threat of one is enough to smarten people up.

Hope this turns out OK.
 
Normally you take the title to a Notary who will check the title against the serial #. The owner should have signed off on the title. The notary then sends it into the State DMV and a new title comes back to you. Its done in every state that I know of like that.

the time I did it it was for a Honda. had to call the finance co and ask for the balance. Then the balance had to be paid off. the title went to the owner and then was transferred to the buyer who paid the taxes neccesasy.

Iowa is entirely different. You fill out the old title and take it to the county treasurers office. They will issue a new title and new plates. No third parties involved, no inspections, nothing. They don't even see the vehicle.

That's how it is in Colorado but you can't exaclty do it that way if there's a lein on the car from a loan. My sticler is the time period. It's been 15 days now. I can't get insurance, I can't get it registered etc. I think the lady's upside down in the loan and she was waiting for pay day or something.
 
The one purchase that I had made like that a few years ago we went to the current owners bank and I paid it off. They had the title on site, the lien was released, and it was signed over to me then and there.

The last vehicle I paid off (a couple of years ago) it took about 3 weeks to get the title from the lienholder (Chase Bank). That's the problem with dealing with an out-of-area lender. It can take forever to get the title.

I would consider playing the CYA card and consulting with an attorney. You might also call the treasures office and see if there are any rules or regulations that require them to have the title in your hands within a certain number of days.
 
I dont know how it works in your state but you had better be very careful.

If you dont have the title,you dont really own the car.

Have you already given her any money?

If so,before paying out any more,demand the title or no more payements until you have it.
 
In my book she is guilty of fraud. She sold you a car and can't prove she owned it by providing the title. I'd have the lawyer call her Monday morning.

I'm hoping this is the problem; the car was apparently financed through Toyota. Plus, I checked with my dad's lawyer and get this: in CO the seller has 45 days to get the buyer the title

My temporaries run out on Monday, I have no insurance etc, that's why I'm ******. I wouldn't be that mad but she said last week that she had the title in hand. Yesterday, she said her mother just got the title from Toyota. Little inconsistencies in her story. Laywer will call if it's not in my hand by this Friday.
 
One more thing: she was all saying "why don't ya drive up here if you want your **** title so urgently" bla bla bla, insinuating a vehcile title is unimportant or something.

Some people are just skecthy when it comes to transactions like this or something. Just no clue.

Got it!!!!!!!!! I knew all it would take is one little slip of the "lawyer" word. It was pretty funny; the last time I contacted here, actually right before I started this whole thread, I was leaving a message on her machine. I started saying, "now I'm about ready to call my dad's lawy......." instantly, she's on the other line.

Not more than 2 business days later the title arrives. The postmark on the envelope from Toyota Credit was July 11th; she told me she paid the car off on like July 3rd. I know I had 45 days or whatever, but after 2 weeks I think it was quite alright for me to get aggitated.

I would be inclined to take her up on the offer, just to get the title and lien release. Usually, the fact of having notified your insurance company about your purchase of the vehicle extends insurance on the vehicle for 30 days, while the paperwork matters get cleared up. You need to verify that with your agent, and pose the question about how to obtain insurance on the vehicle until the title and lien release show up.
