Yep, never MY fault in any way. No you need to mail my check to ...

The Longueira family wants more than get well wishes. They may sue. Alexa's mother, Kim, said: "It could have been an elderly person, a mother pushing a stroller. It could have been anyone."

So arrest Alexa. She could have been a prostitute.

Let me propose that if you're plan on texting while walking, it should be mandated that you carry a white cane to feel the ground in front of you.

Maybe it's just me, but I like to use my eyes and look where I'm walking.

Third thought... what if she was visiting the Grand Canyon?

You'd think that she would've at least washed her hair after she fell into that sewage manhole before getting her picture taken...

They were wondering how to afford cellphones and pay for braces too. Now they've figured it out.

She certainly was careless, but the employees were negligent, and that's far worse. I'd want them fired, or at least suspended, if I was their manager.

Well, I don't look at them as negligent, per se~. For the sake of expediency ..they reasoned some totally rational and highly probable outcomes ..or non-outcomes.

"what can happen? It's not like some numb and dumb girl is going to be walking down the side walk texting and not watch where she's going! My GOSH, man! What are the odds of that happening? Right now ..JUST when we have the cover loose?? Never happen"

When I worked as a gas jockey on the midnight shift ..in June ..I would put my soda down to wait on a customer. When I returned ..I noted all the June Bugs buzzing around and dumped my soda out of fear that one had gotten in side. After this happening 3 times and NOT figuring to cover the thing, I said "Well 3 for 3 there was no June bug inside ..I'll just throw caution to the wind and drink" ...sure 'nuff ..June bug inside.

Leaving a manhole uncovered and without making sure that passers by are warned about it was negligent by whoever was in charge of the manhole. They should have taken reasonable care to make sure that no one falls in it.

Fortunately, the kid did not suffer too many injuries.

I really doubt the outcome would have been any different. She said if she had seen a big orange cone she would have known something was up. I don't think she would have seen the big orange cone.

..but they didn't put one up.

if they had it would have been "putting up an orange cone wasn't enough. They should have assured that a numb teenager looking at her cellphone engaging in the boredom killing business while walking wouldn't fall victim to this totally hazardous situation".

Escalate the excuses as the safety measures were elevated to all but and including a crossing guard for 1st graders.

The workers provided an out as targets of opportunity for the window of vulnerability.

It generally isn't up to the workers to make that decision. There's usually a company policy that covers a situation like that. Where I've worked, there is no higher priority on safety issues such as fall hazards, and disobeying those policies is a serious offence.

I really don't know enough about that company's culture to say how the workers should be punished, or if they should be punished at all, but it shouldn't be acceptable to leave an open hole in the sidewalk under any circumstance.

That said, she certainly should pay more attention to her surroundings. There are a lot of potential hazards out there even when everyone is trying to do things in a safe manner!

I tend to agree, but I've found too many instances where someone was fired for not following policy where the policy had nothing to do with the incident that caused the firing. That is, the policy has to have had an impact on the outcome.

In this case, I really don't think it would have, but since they didn't CYA ..

I had a friend that owned an independent auto parts store. He had a return policy. BIG SIGN. No one read it. He started hanging arrows pointing to it from the gondola (overhead shelf above counter) ..still no one read it. Eventually it was like a vertical slot that barely cleared his face.

As much of a spectacle that it was, people were virtually blind to it and even evaded it to look at him ..never having the notion that there was something odd in having to navigate to talk to him.

I have to admit I'm guilty of doing this. Walking and texting that is- not falling down a manhole. Though I still do look where I'm going, I don't just stare at the phone till I've finished typing.

Texting is convenient and sensible when you want to convey a given thought that doesn't justify a conversation.

Doctor's office calls with an appointment reminder for wife. I would text her so that I don't disturb her at work and she has a visual copy of the appointment (which she may have on her calender already - but I took the call).

..but mobile instant messaging via cellphone just adds the work of typing to a feature length conversation. I guess it would allow you to have a fragmented or protracted conversation while you were doing something else.

Texting works very well when one of the parties has poor cell coverage. It also allows something to be said, without having to disturb someone for a phone call. They can read it at their earliest convenience.
