Me. I'm sueing the thorn that hit my car. And I'm going to have fun with it.




The typical outcome to a small claims court case is "noncollectable". And it certainly seems it's going to be that way with the info the OP provided. So all the posts that say it's a waste of time-is in all likelihood very accurate.


I take it you must not have any experience in small claims or you would know this also.

That's awesome! Especially if one has the time, and don't mind paying the (sometimes) not insubstantial court costs. Locally, it's $175, that's not going to break the bank, but it will increase my losses by 11.6%.

For me, I work a 6-7 day a week job that pays very well. I can't afford the time for a low probability outcome. The financial loss, however, is infuriating. In my case, I chose not to repair my car and to drive my otherwise perfect car, damaged. Mitigates my loss.

I sued my health insurance. They were falling all over themselves to cut me a check. They have to pay a lawyer $400 hr to go to court. It might not work when sueing losers but is a very effective tool for the average person to stand up to a big corporation
 
yup this is why i wanted more information... A skip tracer collects on small claims judgements all the time. There are lots of tricks out there and if you know your way around its an ace in the hole.

Yep- and you have to hire them as well. With the Internet-you have the same resources they have....but does one have the time?
 
Went to small claims court here in AL over a moving company problem. Won the case, but they didn't pay. For $40 I filled out another form anm and garnished their checking account. Got a check from the court for my claim plus all court costs including the $40. Their bank told me they charge accounts $100 for processing garnishment claims. I was happy.
 
When I was working in Small Claims court it was known as "The Gong Show." As others have noted, collecting the judgment is the main issue. Career losers/deadbeats know how to evade collections. That said, IF you know what you are doing AND you are patient you can often prevail.

I certainly hope it wasn't the court employees deriding it in that manner. Government employees with that level of contempt for the people they are supposed to serve should be on the unemployment line PDQ.

The whole point of inferior courts is to give people an opportunity to resolve their differences amicably, instead of self help duking it out somewhere. Real people. Real Problems.

Real people with real problems that make a lot of high pay government jobs with benefits for the people that administer the inferior courts. Without these gong show people, no jobs for the court people. Who ever heard of government employees wondering about whether or not they could put food on the table for their families? Many people that try to navigate the inferior courts on their own are the people that worry about putting food on the table for their families.

Pretty despicable to liken them to the clowns on the gong show. I hope I took the comments out of context.

If it makes you feel any better, we had names for virtually every court division; for example, Paternity Court was known as "Maybe Baby" and Juvenile Court was referred to as "FFA"- Future Felons of America.
 
Catchy, but no, I suppose context is everything here.

Paternity courts? Thank goodness for DNA, even with its flaws. We had a guy that looked at baby's ears and Dad's ears. If he thought they matched, eighteen years for ( maybe ) Dad.

One of the few useful things I have heard our new President say, might indeed apply to this situation:

"You know what they used to do to guys like that when they were in a place like this? They'd be carried out on a stretcher, folks,"

Get your pound of flesh, in court of course. It will make you feel better.
