lol.. true! Once a guy saw me looking at him.. he finally got it right and he looked over at me and I gave him this..

I think there's enough anger in this world to give the guy the finger, instead of the thumb.. But who knows some deranged person might've gotten mad at me, then again I was 3x his size, lol.. Might've thought twice of a guy who is actually taller than his hood of his truck.

back to the OP.. I'm so glad you went back to get something from your car! So you could video this moron trying to hurt your car. Hope he's been arrested by now (I didn't read all 10 pages).
 
I don't understand why anybody backs into parking spaces, unless there is some extenuating circumstance that will make it difficult to back out later. I see a lot of people do this and it always takes them multiple tries and they still end up crooked or on the line. Also most people seem to keep backing up until their tires bounce off the curb, sometimes pretty hard. Of course you also have people that pull in and keep going forward until the front of their car scrapes the sidewalk or curb and then they back up a few inches. Basically a lot of people just stink at parking.

I always park in backwards for two primary reasons:

If I'm driving the Porsche, I never know when I'm going to come back out to my car, and see that it is flanked by large pickup trucks, or SUV's, that I then can't see around or through as I blindly back my car out into potential cross traffic. If I am parked in backwards, I don't have to strain my neck to see when I poke the nose into the traffic lane.

Second, if I'm driving the Porsche or the wife's Abarth, those noses are very low to the ground, and its a lot safer to back the car in, in case I misjudge the distance between the tires and the parking curb.

Does not seem like you involved the police properly. You can't wait and let time go by. If the damage is in the felony range, you want to ensure he is charged with the crime.

Being kind or soft in such situations will not serve your interests, or his, in any way.

This is what I read in it:

"Called the cops. Got a report. He will most likely get charged with criminal property damage.

Called Insurance got a report. They are going after his insurance company.

Walmart pulled security footage."

Of course, but having experienced this, I can tell you, without a doubt, the police have a choice as to whether they charge him or not. I certainly can't predict what the local cops will do on their own. Around here, it's likely they will forget... And when enough time goes by, (about 1 month) they may not be willing to charge the individual at all.

The bottom line is that I got screwed. I don't want to see that happen here. I explained my experience above. I mentioned multiple times that charging the individual is KEY to success.

I promise the owners insurance company does not have to pay the total.
I also promise that the truck owners insurance may be unwilling to pay.
That can leave the OP in a situation where he prevails in court, and the criminal walks out, without paying, as he WILL NOT BE COMPELLED TO PAY.

Unsurprisingly, people that behave badly are often no strangers to the court and know what to do to get away with as much as they can.

OMG, that's crazy man. That guy has some issues, that's for sure.
 
UPDATE: Found him on Facebook and have been talking to him. He admitted to it all. I'm assuming he wants to work it out of small claims court. If not the messages are plenty of proof. Even talked asked about the driver side of the car before I said anything. I'm gonna try and call the police department back and pressure them to file charges. I dont like to talk about where this occurred but it was in Topeka KS. The PD in this town is really understaffed and have high call times. I can't wait to get back in a smaller town.

His Insurance should be paying for all of this, no court involved.

His Insurance should be paying for all of this, no court involved.
They might not cover it since it was intentional. I sure hope his insurance covers it though. Would be a lot less headache.

That sounds like my hit-and-run experience, he wanted to get it fixed where his dad works and outside insurance, EL-O-EL-O-EL, yeah, I don't think so bud.

Bluntly put, I probably wouldn't have even considered contacting him on Facebook. With situations like this, don't the authorities advise no contact anyways?

He damaged your car by dry humping it with someone else's car (I personally think this is a bit odd, but hey..), but now he's very accommodating and accepting fault? Ever see the movie Split? Clearly, the dude has issues.

First impression is this sounds similar but not the same as the scam where a carful of people pull up and park about two inches away from the door you have to exit... then when you open your door to make exit you "hit" their car and they become super extremely aggressive and want money on the spot to make it go away. Usually about $200.

The proper response is to let them know to call the police and report it to their insurance, then drive away. If they follow you, then you phone them. They won't follow you if you say this.

I WAS going to say that with my luck, the guy would be behind the counter at the body shop. But now I can't.

If you find yourself on Facebook with him again, ask him if he stopped beating his wife and kid.

LMAO. I got to watch what I say on Facebook. Everything has been documented and I'm pursuing Criminal Charges as well as Civil Charges. He doesn't want to pay up and act like a child. He's gonna get a dose of reality.
