Yup I did google them. My Farmers agent also went head over heels for me too by calling them and getting a claim number and claim started. They said they have never seen such professionalism. Had them on hold for 30 mins. Had me on hold for 45 mins. If I cant go after them, I will have to go after the San Francisco Examiner newspaper.

In most cases, it does. Usually, business can't be held liable for an independent contractors operations unless they're illegal, inherently dangerous, or cannot be delegated due to the nature of the job. But you're sure welcome to give it a shot.

Good luck with that.

If the car meant that much to you and you can't afford to fix it yourself, you should have had full coverage.

The fact is that you had it parked in a common area (I assume a parking lot of some sorts). Things happen, mistakes are made, and if the car really was that important you should have anticipated the possibility and kept it out of harms way.

Man if you have nothing good to say then dont say it at all. I am not in a parking lot. I am in an upscale neighborhood which is a cul de sac. I parked in my own drive way. The really important S class Mercedes is in the garage. My smaller Mercedes is outside if you must know.

I beg to differ. I have dealt with both tier 1 name brand insurance companies and tier 2 high risk companies like TOPA but a different name. The name brand tier 1 companies are leaps and bounds above any of the tier 2 companies.

Do not get me wrong, tier 1 companies like to mitigate costs and risk, but usually they are not hard to get a hold of, nor will they totally be unavailable.

The point is that this wouldn't have happened if this person was not in the country.

San Fran is flaunting the law of the land too.

US gov't not doing their duty to enforce the laws of the land.
That is not a political statement. It is a LEGAL statement!

I'd definitely have your insurer go after the SFE for liability . Even IF he is a contractor they have a legal obligation to make sure that the person representing them by way of delivering the paper is fit for the job.

No need to bet the farm. This guy is an illegal immigrant from Peru. Showed me this document from Peru as ID. I used to work for US Customs but since I am visiting from Las Vegas- nothing I can do here. Police do not arrest illegals here even when they are driving with out a DL. In Nevada esp Las Vegas, Metro Police would have hooked them up and towed their vehicle and cited them. He would be held in Clark County jail until ICE comes to pick them up and that is after all the fines are paid before he can leave. In California, they do not care. The officer did not cite him, did not want to write a police report, and was annoyed that he could not go to breakfast because I dialed 911. His partner kept calling him on his personal cell phone. Unprofessional. Now I am stuck with a $1928.00 repair bill. A newspaper (San Francisco Examiner) giving me the run around, and the drivers insurance giving me the run around. My own insurance is having trouble contacting his insurance.
 
If you've got any lawyer freinds, you might be able to put a scare in the newspaper, or the insurance company. Threaten to make lots and LOTS and LOTS of bad publicity for them (then do it if you don't get satisfaction).

You have at least a moral case, that you contracted with the newspaper to get daily delivery without damaging your property.

I've heard of longer stretches to go after "deep pockets" that were successful in the end.

Well the problem is..I did not order any newspapers. The San Francisco Examiner is given out for free unlike the San Francisco Chronicle which you have to pay for. I am going to call Channel 7 tomorrow and let them know about this.

Welcome to the downside of the "Whats good for business is good for everyone else" philosophy. I'm sure you don't mind taking a financial hit so that the community can get cheap papers.
 
Your options:

1. fix it yourself.
2. stop posting any of this online. find an attorney and put pressure on their insurance company. or put pressure on the paper for not doing thorough BG check on their contractors.
3. you might be able to publicly embarrass the paper but likely to just get yourself stuck in an ugly dispute. you could get yourself in trouble if you aren't careful.
4. go to local media if they have a spot for insurance hotline, legal hotline, etc.. some have a weekly segment or call-in.

My guess, however, is that whatever fight you do will be aggravating, and not worth $2K unless you can hire a good insurance lawyer that knows how to squeeze the other ins. company. I doubt you will come out ahead.

May want to start carrying comprehensive policy on your property from a reputable insurer.
