I am not a lawyer.

I agree with changing the tone of the the original letter draft. Only in the second or third letters do you get into that kind of tone.

You keep talking about the MLS listing. But what about the desription in the papers you signed? Did it refer to the MLS listing? Therein would lie the legalities.

Most MLS's have a disclaimer "Information provided deemed accurate, but not guaranteed".

As a Realtor in Texas, I must ask, is your Realtor YOUR Realtor or the builder's. In other words, do you have exclusive buyer representation, or does the Realtor work for the builder and is acting in a "dual agency" mode or maybe you are the Realtor's "customer" and the builder is the Realtor's "client" (laws and terminology very from state to state.

You will have to look at the "spec sheet" or "order sheet", not the MLS info. There should be a supplemental order form or build form to go along with the contract that spec's out building materials used.

Your municipalty's Gas Dept should be able to tell you if gas is available at your property.

You may want to take the issue up with the broker.

When you say you sunk an extra $2500 in upgrades, has this been prepaid?

I have my own agent of a different company than the listing agent who works for the builder.

The $2500 is prepaid for floor upgrades and extra concrete parking.

I don't know what you local gas company's rules are but I added gas to my all electric house for a furnace upgrade. The Gas Company charge me about $1000 to connect to their supply pipe, install pipe up to the house and set a meter. I did all of the trenching myself.

IMHO RE agents = car salesmen, never trust either.

At this point Real Estate Agents "SUCK".

Stopped by the house today (I drive be every day) and guess what the build was there working on some stuff. Got to talking with him and he offered to put a propane fireplace in.

Easy as apple pie. I agreed to what he offered and deal done.

Had to call my agent and have him pull the letter that I was getting ready to send.

Get the buuilder to send you a change order that both of your sign, to make sure it is documented that a propoane fireplace is now specified.
