If BMW were to do something like that it would be like when Beretta sued Chevrolet for copyright infringement, it would be a waste of time.
Judge ruled that nobody would get a gun confused with a car, therefore no copyright was infringed. So, if nobody would get a tire confused with a car, there would be no case. It has to be actionable and injurious which means actually taking an opportunity away based on the infringement.
Except that the Bayerische company DID win a tort just like that against the (Ford World rally Championship Team) rally prep company/team "M-Sport" (short for Malcolm Wilson Motorsports) for copyright/trademark infringement on their whole ///M thing.
Made them change the marquee name to "MS-RT" instead, so it
does happen.
I STILL have M-Sport stickers/badges on MY car though, procured BEFORE this whole suit happened, so pound sand Bimmer!
