[Mis]use of arrow boards along roadways/legality

Is there a specific law or DOT regulation regarding the use of MUTCD arrow boards near the roadway for purposes other than to indicate a lane closure? There is a business several miles from where I live that -- at certain times of the year -- uses a Type C panel arrow board pointing to their billboard. It is positioned maybe 20 feet away from the road. It is flashing not only during the day, but at night as well, and this particular stretch of roadway is a divided highway with 2 lanes each way, 45 mph speed limit, and is not particularly well-lit at night. I'd imagine this almost has to be in violation of some kind of DOT regulation. Anyone here more well-versed in law regarding traffic control devices?

That sounds like a potential hazard. Maybe it's time to check with the local PD.
 
Not only does the lighting cause distraction the actual placement of the board can obstruct a motorists view. I've seen this problem a million times and it is dangerous.
 
We had a business here in Toronto have to reduce the number of flashing lights on their large storefront sign. It was deemed too distracting to drivers as it was by a busy intersection controlled by a set of traffic lights.
