My E430 got into an accident on July-04, the fault was my wife tried to avoid hitting other driver cutting her off while she exited Highway 73 to local street on Newport Beach.

The left side of the car was repaired to our satisfaction at our choice of body shop, I paid the $500 deductible the rest Mercury paid.

Everything was good until I have the tires rotated at America's Tire 3 week ago. The front left tire had severe damage on the inside, I had to replace 2 tires because it isn't safe to have 1 new tire and 1 half tread on the same axle.

I contacted Mercury Insurance to file the extra claim out of accident more than 4 months ago. A claim adjuster came to the house to look at the tires, first he said that Mercury will paid a pro-rate for damage tire, but the other tire would be my responsible. The tread remaining was 6/32" which is 60% of the new tire with tread depth of 10/32".

I expected to receive at most 60% of total cost for 1 tire, mounting+balance+tax, of $141.xx. Today I received the check from Mercury Ins for the full amount of $283.xx for replacing 2 tires, after I mailed them a letter saying that even the damage was only 1 tire, but I replaced 2 tires on the same axle for safety reason. They seem to agree with that and paid full amount of 2 tires instead of 60% for 1 damage tire.

There is no better service than this. I'm very happy with them and will stay with them forever.
 
Sounds good, but shouldn't they have agreed to that the first time as it seems that was the correct repair? How many people are not getting what is fully due to them because they settle for the first answer they get.

That's what insurance usually does. Pay you out less the first time you ask and then fix the problem when you ask them. In your case you didn't have to ask too hard, but you had to ask, which shouldn't be the case.
 
I took the car to 3 body shops for estimate. All 3 didn't notice anything about possible tire damage inside or outside. There wasn't any damage/scratch on the wheel, therefore the body shop didn't take off the wheel to repair/replace the front bumper.

The car was show any unusual behavior on and off highway for 4+ months. Only when I took the car to America's Tire for rotation they saw the damage.

In my case, I claimed the tire was damaged from an accident 4+ months ago, and Mercury accepts it. They may be able to deny the claim saying there is no proof that the damaged tire was from that accident.

Sometimes it just comes down to who you talk with on the phone or who your adjuster is. In the end they made good and that's what counts.
