Lady slammed into me yesterday. Need advice

The OP can always put it through his own insurance carrier first. They'll supply a Lawyer. If you don't feel that's working for you, hire your own.

Having been on the illegitimate receiving end, I'm also very anti-lawsuit.

Given the situation, you often don't have a choice.

I will be seen by both Doctor and lawyer. I will make appts tomorrow. I have liability and uninsured on my car. The cop verified the insurance was valid. My insurance doesn't want to get involved. The neck pain is gone today. I do have an exchange of info the cop gave me and the accident report will be available tomorrow by noon. I AT THE VERY LEAST just want any medical bills paid, my missed work paid and my car fixed.

Just the fact that the woman driving had a suspended license and likely has no insurance you are going to have to have your insurance company go after the company that owned the truck. My guess is that the woman has no assets of any real value. Sorry.

Don't let your insurance company off the hook, part of what you are paying them for is such service to pursue to company owning the truck.

Be firm, polite, but very persistent with YOUR insurer to take action on your behalf.

Absolutely get any injuries, even if they are not easily documented (strain, whiplash ect) recorded by a certified hospital.

Wouldn't The issuance company of the SUV cover the damages to my car? I will still get a lawyer. Sorry for sounding dumb, just have never be in this situation

See now Dr. Dusty, if you had been driving a small car, you could have avoided this accident because you would have been a superior driver.

So sir, what WERE you driving? It had to be a behemoth like an Excursion or Suburban for you to be unable to avoid the collision!
 
You need to contact your own insurance company ASAP and let them handle it. No need for a lawyer just yet; it probably won't do you any good at this point.

Maybe. The person driving the vehicle was not a licensed driver, so who knows.
 
This woman seems like she has a lot of problems maybe she needs your help.. I dont kick a person when he or she is down because when i used to do things that way carma got me its nice to be nice sometimes

WHAT? The woman hasn't had a license for 7 years and was driving when she shouldn't have been, and in the process injured someone!

Here's the best way to handle this entire situation:

Hunt down your insurance company's website, and find out how to file a claim against your insurance. Once they have a claims adjuster assigned to your case, give them all the details involved.

When the adjuster asks you why you want to file the claim with your insurance company, simply tell him "Because that person's insurance company isn't as good as mine is. I pay you money to take care of me, not them."

The adjuster will ring up an appraisal of your damages, and write you a check minus your deductible. Take it to your preferred shop, and get it fixed, adding any additional adjustments to the claim to get the vehicle perfect again. Don't accept the vehicle back unless it is in fact perfect.

After everything is said and done, your insurance company will then go after the other company for your deductible back, plus all the money they paid to have your vehicle fixed. you will eventually receive a check from your insurance company for your deductible amount. Usually about 6 months later.

If you have pain and suffering from the accident, talk to your claims adjuster about it, and see what can be worked out. They will get that back from the other insurance company, also.

I highly recommend against the knee-jerk reaction to get a lawyer involved. This is an open and shut case if you have a decent insurance company, and have collision and comprehensive coverage on your own policy. I personally have been screwed over by insurance companies and lawyers before, so I have learned how to deal with them to my advantage, and the advantage of my friends whom I have helped with quite a few claims over the years since my bad experiences.

They say my injuries are superficial, but they still hurt like [censored] and even with meds sleeping is VERY difficult. Her insurance company STILL hasn't called me back for an Adjuster. It is approaching a week. The company that owns the truck is a very large company, which is responsible for their truck. I have ALL my documentation in a binder. The lady was rude, the insurance company is stalling.. I have little choice but to get a lawyer. They are sleeping pain free, I am not. They WILL pay. I'm going for EVERY Dime I can. There additudes suck in the way they are handling it.
 
You need to get a good lawyer involved in this. You might be surprised how quickly the insurance company's attitudes change once they know you have a lawyer on your side. Keep on with your medical treatment and document everything that happens and every conversation, email, letter, personal contact etc that is associated with your case. Proper documentation and hiring the right lawyer are your best ways to keep from getting screwed over.

I agree with bladecutter,
the repairs to the car any and hospital bills will be taken care by your insurance.
you have to sit down and make list of lost pay and hardship and make a formal claim to their insurance agency (??) for that amount.

DO NOT sign and release/waiver or whatever it is called for you bodily injury.
make sure you car is inspected throughly after the bumper is taken off etc.

if I had back injuries, I would get treated. get a lawyer and sue the owner of the truck which is a construction company?? if the woman had a suspended license, the guy who gave her the keys is culpable. the insurance follows the car and not the driver. now if the insurance company says she isn't their insured, it's a lie b/c the owner of the truck gave her permission to drive the vehicle (suspended license or not). If you want to play hardball, go after the construction company assets if their insurance company won't pay a dime. The lawyer will find someone to pay up trust me.
 
I got a lawyer. He is working on the case. Her insurance co HAS YET to call me back for an adjuster. I want my pain and suffering rolled into this cause its a major headache

Good for you....the important aspect about the lawyer is that the insurance companies KNOW that you will not settle for less than you are actually entitled to. Hopefully this will put them in the right frame of mind to pay out the fair and reasonable costs that are the result of the other driver's actions. After all it is going to cost them WAAYY more to use their team of professionals, so better to pay up sooner than later.
