Absolutely! The further fact that a higher flow exhaust system was installed bolsters Subaru's likely held assumption, mistaken or not, that the owner thrashes his car beyond reasonable expectations. I hope scoobdude didn't lease...

Nope i did not lease. And the fact that Subaru sells short throw shifters does not help them any either. Besides, it was on there only two weeks before i took it in the second time. I think i have a really good case and may have to just take it to small claims.

Oh well. I will get it resolved one way or the other.

However.. could someboy please answer the question about running thicker oil (85-140 RP) . I honestly think it would help especially with the texas heat.

Not taken wrong at all. Posting in general sounds harsher than a conversation...

I was just suggesting that in the future, you might want to consider removing after market modifications that would raise the question. If you had taken the stuff off there would be no problem at this point. I know its the principle but you can avoid the argument....Takes less time and energy to remove a few parts than to write letters, make phone calls, meet with district reps, and generaly stress out. I hope they reconsider....

You could take the stuff off and try a dealer way far away???

Your VIN is probably flagged by now though...

here is Mr. Adcock's reply

Mr. McMeekin,

I understand our CDS group has been in touch with you today and an appointment with our District Service Operations Manger Tim Powers, has been arranged. Hopefully we can resolve this matter to your satisfaction.

Fred Adcock

You can read above how the meeting went so here is the new letter

Dear Mr. Adcock,

I am really sorry to bother you again about this same issue. Unfortunately I was very dissatisfied with the meeting I had with Tim Powers on Friday the 10th. Part of the dissatisfaction was my fault for being unprepared on Friday. However the meeting was originally set up for Tuesday the 14th. I still believe if I had the paperwork to show Mr. Powers he would have reconsidered since I could have proven the problem was pre-existing. This would have been proven with the original repair order from February for the same 1st gear grind. The receipt from July for the exhaust would have further showed this was a pre-existing problem.

The reason for this second letter is because I still feel my case has not been heard properly. I regret that this particular case has had to come to your attention. However I feel I am being dealt an unjustifiable solution. All I am really asking is to have my car fixed under the warranty that came with the car. I honestly believe SUBARU builds an excellent product. And I also honestly did not and do not want to believe that SUBARU treats its customers this way. Please help me reach a viable resolution to my problem. I am only asking for 1 of 2 things. 1) A logical or technical explanation of how the failure could have been caused by the aftermarket parts in question before they were even possessed by the owner of the vehicle in question. 2) A repair to the vehicle in question.

Please help me in the situation. I am only asking for what I believe is owed to me. If you disagree or find there is nothing you can do please provide another route to seek one of the 2 resolutions I am looking for.

Thank you again for your time,

Joseph

Transmission was torn apart yesterday. everything looks fine. however the dog teeth on the brass synchro were really sharp and they are saying that is probably what it is. I still believe its the oil ring/groove on the other side. But they are going to replace 1st gear and 2nd gear with the entire synchro assembly.

P.S. the mechanic said it was actually easier to drop this transmission becasue of the exhaust. go figure huh
