Yesterday my boss sent me in there to get a part for a customers car. They had some flyers on the counter.

I grabbed one and took it home (they are free). I found something I needed so I went in there today to get it.

I had the flyer in my hand.

The thing rang up @ $40something. I showed the guy the flyer and also showed him the same add in the others on the counter.

Notice in the add it's $25.92.

So the sales guy goes in and talks to whom I guess is the manager. Comes out of the office and says that they can't discount it to the price in the add!

I ask why not since it clearly shows it at a much lower price than it rings up. He says that it's the price it rings up and thats it.

Is this legal? Bait and switch?

If it's exactly the same, then it's illegal down here (and in some cases you'd get it free for mis-ringing).

If they've run out of the exact item, and put another make/brand in place, I don't think that it's illegal to charge more.

A new Napa not to far from here was charging $3+ dollars per quart for Delo 15w40. The date on the bottle was from early '05. Clearly an example of Napa price gouging.

If that is THEIR flyer and the sale date has not expired, then they are legally bound to sell you the item at the advertised price. Out here in South Texas, the guy would have been eating that flyer.

With M. Waltrip going to Toyota next year, I've given up on buying his diecasts, and stopping at Napa any more. The main reason though is because I was sold the wrong rear brake parts twice.

I had a local shop do that to me to. I ordered some brake rotors, the left a message on my phone telling me they were in and were $14, just what he quoted when I ordered. When I went to pick them up they were $22. I told him that I was told $14 and even offered to let him listen to the message, but he wouldn't budge. Too bad for them, they had to pay to have them shipped out.

I know the flyers. Some parts stores have piles of different ones.

If they have NAPA anywhere on that flyer and it's current, it's illegal to charge you more in CA, OR , WA (states I've lived in) - probably other states , too.

That sounds just like a napa store to me. In my opinion Napa is or was the most most overrated chain auto parts store out there. Have not set foot in one since the early 80s. My experience was way to many screw ups from them.

Napa has everything Id need, and the good ones do a nice job... You pay a little more, but if you want an alternative t an OE part that you know if high quality, they do pretty good.

That said, they are my last choice, due to high prices and apparent gouging on things like oil and whatnot...

That said, lets not get too spoiled by the oil prices at wal-mart, for example, which are artificially low due to excessive leverage (not that I mind paying the lower prices

Chris,

I worked retail from age 14-18 at a Supermarket and I know for a fact that advertised sale items....AKA....'price changes' are downloaded weekly into store's computer system from the corporate office. There were many times in which not all the price changes were in the system. So it didnt matter if you went to 10 different stores, all of them would have the incorrect price when you got to the cash register. I didn't know if it was a glitch in the system....or someone at the corporate office forgot to change the price for the upcoming sale.
The manager is wrong for not honoring the $25.92 sale price in the NAPA flyer. If I were you, I would call the corporate office and complain.

Go to another NAPA and see if it also rings up incorrectly for the same exact part #.

I had many customers call me a crook, cause they thought they were a victim of bait and switch.

I highly doubt a very large retail company like NAPA would purposely break the law.

Do you guys know these flyers of which (I think) Chris142 speaks? NAPA's, joeneezeits, Bob Speed shop, Car Quest has 'em.....kinda generic...sell tools, transmission flush machines, parts, mag lev devices, etc....

One last thing about price changes....

Every Thursday morning between 1-2 AM our system would automatically download the price changes for the upcoming week (sales flyer). In the 4 years that I worked for Publix Supermarkets, there was not 1 week in which 100% of all advertised sale items/prices were downloaded into the store computers/cash registers/Toledo weight scales (for the deli, meat, produce dept). So none of the employees would know about the problem until a customer complained about the incorrect price.

Simply ask the NAPA store manager for the phone number for the district manager and corporate office and you will get Permacoil for $25.92

That NAPA manager is a lazy sack of dog poo for not wanting to keep a customer happy and do the right thing.
