I would say, (with no technical basis) the outer sidewall rubber is not a structural member of the tire like the tread, cord or bead. It's more cosmetic. As long as the inner sidewall isn't damaged, I'd have no issue driving on a tire fixed like that.
Allow me to confirm that the outer rubber layer - not the cords - is not a structural part of the tire. If the damage is contained ONLY in the rubber - and not the cord - then there is very little danger of the tire blowing out due to this damage. Just for confirmation many racing tires do not use that outer rubber layer.

Damage to the cords is the complete opposite. In this case, it appears the damage may be deeper than just the surface rubber.
