Basically, Apple is seeking an injuction against HTC because it's phones, as well as what is mentioned in the article.

A. Are in a general square shape
B. Have a black bezel
C. Have buttons at the bottom
D: You interact with a multi-touch interface
E: You interact with icons.
F: The CPU undervolts itself to decrease power consumption

Because, according to steve jobs, apple has patented all of the above. Seriously? [censored] apple. You know what they say, if you can't beat 'em.....

Sue them out of business.

For those that don't speak lawyer, this is a well summarised explanation of the patents by a commenter


The first patent applies to pretty much every computer program ever written.

The second applies to any device that plugs into any other device.

If these patents are valid then Apple now owns the planet. Sorry, the iPlanet.

I doubt this will be successful. I think Apple is just "trying their luck" to see how far they can take this. Quite frankly, they'd have to sue about 90% of the smartphone market because they all function exactly how bullets A through F state.

Oh and Apple is sueing Samsung too. I forget why, it escapes my mind at the moment. Something to do with the displays or something.

They ARE suing essentially 90% of the smartphone market.

They are suing Samsung, and Motorola as well. Slightly different, but somewhere is mentioned the fact that essentially they look like the iphone. Because you know, you can patent a very general shape

An undisclosed amount of money will be given to Apple, and things will go on the way they always have. Apple are the lowest people in tech and don't like competition.
 
I just bought an iPad 2 for my wife as a special surprise (she has been talking about it a lot). she loves it.

I must say I am happy with windows products.
 
This is not a big deal - companies sue each other all the time.

Microsoft vs APPLE
Nintendo vs Atari vs SEGA
Barbie Vs BRATZ
Cats vs Dogs

I swear sometimes is just for publicity and to keep their names in the public mind.


I personally have been an Apple guy since long before they were cool (I was made fun of in school during the "Dude, you're getting a Dell" campaign) I LOVE their computers always have always will. BUT I am smart (and AWARE) enough to realize what glitters isn't always gold. -And therefor I don't buy into their phones or iPad. Smartphones by samsung or Htc or iPhone are all very similar to me and therefor I go by price (iPhone = expensive = not a GOOD value )
But I digress...

Apple is nothing more than a life style company. Selling trendies on the fact about how Kewl they are, and how "sick burn" it is to wait in line outside an Apple store at 2 AM so they can be one of the first to get whatever Ime product just came out.

The most amusing thing is how they have convinced the media that they are innovators. LOL.
 
The only reason I got a mac is because my school had a deal for $800 off + apple's student discount. Ended up with a Mid 09 15" Macbook Pro, Core2duo 2.66ghz, 512mb vid ram and a 320gig harddrive for $1100. It was a better deal than I could get on any windows pc with those specs at the time. I love the mac, but find myself booted into Linux Mint more than OSX.

Apple ought to get into the car market next. Perhaps they can patent a "a 4 wheeled vehicle capable of transporting persons powered by an I.C.E.". Its not like they haven't attempted to patent prior art in the past. Can't wait until the multi-touch display patent that Stevie has such a boner for eventually makes it way to court. I was reading on one of the tech sites that prior art for that goes back to around 1984 or so with a dissertation from a comp-sci guy in Canada and that prior art for their "real time parsing" in an OS goes back to the mid 80s as well.

This is America, everyone sue everyone else and at the end cross license each others' patents. If you are a small guy like HTC, unfortunately you are short of luck because you do not have enough patent like Motorola, Nokia, Samsung, LG, Erickson, Siemens, Qualcomm, TI, Infineon, etc to counter sue and balance the power.

I don't think HTC will die because of this. They most likely will end up paying a couple percent of some stupid royalty, ask their customer (ATT or Verizon) to back them up by threatening Apple, or license some patents with other big guys to cover some of the things that Apple haven't covered or do things differently.

That's how the bloody lawyers got rich for nothing and drive the small businesses out of businesses in America.

This is about those email with automatically highlighted hyperlink, email address, or phone number because they "look like it". I don't think others have done it because 1) it consumes a lot of processing power, 2) it can be wrong and when it is wrong it is annoying, 3) security risk if they are automatically added to your contact list. They can remove it, no big deal, I don't want it.

Most likely HTC would be covered by Google or Microsoft if their OS is used as is.

Patent 6343263:

This is about a data mux that can connect everything to everything else regardless of transmission type (voice, data packet, boot info, button, USB port, ethernet, codec, etc). I don't think it is a big deal for HTC because there is probably a prior case and since HTC bought chips from others, they are covered by the chip vendors (usually a big guy that has way more patents in this area than Apple).

Most chip vendors don't use this because 1) it is expensive if you already know how to connect what to what and 2) it is slow by converting one thing to another then back to the original format just to share a mux and 3) chips you buy in a package (i.e. snap dragon) already has everything set up with 1 to 1 connection, and you don't need to mess around with connecting things as a customer.

And no, you probably can't patent a rectangle bar of plastic / aluminum / glass with black frame that can make phone calls and have buttons.

Reading about all these lawsuits makes me feel like a complete idiot for owning an iPhone.

The criteria they use as an excuse to sue is just ridiculous! It's like GM suing Ford because the Expedition:

A. is a station wagon
B. is available in black
C. has buttons on the dashboard
D. has an automatic transmission with a shift lever
E. is operated by turning a key to start the engine
F. has a battery saver feature to avoid running down the battery

I genuinely hope this lawsuit is unsuccessful, so it's a big slap in the face for Apple.
 
Colors and shapes can be part of a trademark so it is not a surprise that lawsuits about these happen. A company has to protect its intellectual property.
 
I think the title -Beginning of the End for HTC -is a little dramatic.

Honestly, Apple is just the hot brand at the moment. In the 90s I was made fun of for owning an Apple -And apple was just about bankrupt.

This whole EVERYTHING goes around in circles...
 
Well, how the patent is submitted and approved may be a different thing, but the fact that Apple is successful on creating design trend that are followed/copied by other company is a reality.
