No, he's not entirely incorrect. The government has gotten pretty good at finding who is using tor, and tracking what they are using it for. Because a statistically large percentage of what Tor is used for is illegal drug/weapon sales, illegal types of pornography, and that type of thing. But like with most other things, if you keep your nose clean you don't really have anything to worry about.
