I have actually measured how much oil is in a 5 quart jug. Have you?
Yep! In fact, comes right out to 5 quarts!
(edit: I can only speak for Motorcraft and M1 5 quart jugs coming out to 5 quarts, the only two that I've bought since they have been selling them in 5 quart jugs.)
I've measured oil contents of several 5 quart jugs, from Mobil 1, to Pennzoil and Quaker State. The Mobil 1 0w-30 jug had an extra 4 ounces in it, as did the Pennzoil Platinum 5w-20 and the Quaker State Torque Power 5w-30 had an extra 8oz in it. I had one on my shelf that was even slightly more full (didn't measure it, but I did weigh it) and it had roughly 10oz extra in it. I've also got a Valvoline 10W-30 full synthetic Maxlife jug that quite clearly has more than 5 quarts in it.
