UPS and Ebay

I have many auctions going on ebay right now and of the two that have been shipped one of them has been damaged due to obvious abuse by UPS. The auctions were stated that the items were AS IS and working at the time, however, one of the boxes had everything in it destroyed due to shipping. What would your recommendations be on this as I know I packed the box correctly? I want to make sure I do things the right and honest way and don't want to just say well "as is" as I am a firm believer in honesty and karma. Would you have the buyer keep the item and suggest they file a claim with ups? Or what action would you recommend? I just want to make sure everything is done on the up and up and the right "honest" way.
 
Oh and sorry for spanning this across three posts, but, I have asked that the buyer email me pictures on this as well.
 
Things may have changed, but the shipper (you) should be able to file a claim with UPS. Last I knew it was either the shipper or receiver could file a claim. In the spirit of good feedback, I'd offer the buyer the opportunity to file the claim himself or receive a refund from you after you file a claim.
 
When I have this problem when selling on Ebay, I eat it. It just seems like good customer service (and it keeps negatives out of my scorecard.)

(Oh, and don't bother filing any kind of claim with either UPS or USPS, they will dink you around until you just give up.)

Very tough situation. There's no burden of proof anywhere unless you took pictures/videos of your packing. UPS will stay, "sorry -- we didn't pack it -- can't guarantee it". Was the item valuable? If not, you might have to write it off as a loss. I've only had items partially damaged, but never a total loss. I refunded some of the total to the buyer, and they were happy. There's very little protection for seller. The buyer will almost always get their money back if they file a claim.
 
And Bandito I took your advice as I just want to make sure I get this taken care of for the buyers sake. I know I've been on that end before and just believe...Well you know the golden rule and if you don't it comes back to bite you.
 
Well I do have pics of the items before packing and waiting on pics just to make sure I'm not being scammed out of my money either. I have let the buyer know that I really want to work with them on this for a resolution.
 
Typically the receiver files the claim with UPS. He'll need to keep the box, packing materials, and of course what was shipped, because sometimes UPS will send a rep. out to see it first before they cover it.

If they find they're at fault, they'll pay up to $100 unless it's insured. Refunding as a good will gesture on your part is up to you.
 
Have an EBAY order from JC Whitney that was damaged in transit.UPS shipped it back to JC Whitney.Yet they have not said a thing about it to me.Tracking information is worth its weight in gold...
 
So it looks like the package was given what I would call the Ace Ventura treatment via ups. Will be filing a claim with them on this
 
Also because of this I am going to eat the cost of both the item plus shipping once ups has the item. Man so here goes the claims process....
 
Ive been an Ebay seller for over 12 years and I can't stress enough to insure every package. If the delivery company takes your $$ for insurance then they can't pull that "we didn't pack it" line. Always keep your receipts and I never leave funds in my PP account as they will be frozen if someone files a claim. It is true that Ebay will not protect their sellers so it is up to you to protect yourself.

Bingo. Put it in your S&H charges.

There is a mistaken idea floating around out there that if the buyer chooses not to get insurance any problems are "on them". Nope! They can still complain through their CC/PP and win.

I've had more stuff mangled by UPS than by all other shippers combined.
 
Very odd, and coincidental that my damage was to Infinity Kappa Coaxial speakers! Wonder if it's the same buyer? I made a conscious effort to pack well: had original box and double-boxed. Still, somehow the speaker grill got broken during shipment. Who uses the grills for coaxial drop-ins anyway? I refunded him $15, and he was OK with it.
