I had a guy who rearended me on Monday, and he claims he has Allstate Insurance. They are trying to verify if he even has coverage with them. I got his:

1) Name
2) Address
3) Birthday
4) Driver's License Number
5) License Tag
6) VIN

If he does not have insurance what do I do:

1) Call the Police
2) Report him to the MVA
3) Get a lawyer and take him to court
4) Use my uninsured motorist coverage
5) Let my insurance company handle this

I have called him a few times and he has not called me back. Would the MVA be able to look at the VIN and tag number to see if it is insured or can my insurance company or Allstate verify this info. Thanks guys for all your help.

Call the police. Get a report then contact your Insurance. They will take care of the rest.

Your insurance will require the report.

GOOD that you got the info!

My wife got rearended by an idiot with no insurance a year ago, our insurance company handled it so I would turn it over to them.

I had a similar experience years ago. The police came, took all info, and told me the guy had insurance. I called him the next day and he said he was taking care of it. Called a few days later and his phone was disconnected. My insurance company (State Farm) went after him, but never found him.

My advice, call your agent, get your car fixed, and let your insurance company worry about getting any money from him/his insurance.

I will call the police tonite, and if this happens again, meaning I get hit the cops are coming, no if and or buts. His car is really smashed up in the front and I still have some of his paint on my bumper.

I am glad I took the tag number and VIN. I did report the accident to the insurance company 2 hours after it happened and yesterday the Allstate represenative took pictures and gave me an estimate for the damage.

I did not call the police because in Maryland if it is a minor accident they want you to exchange info and call the insurance company, I have never run into something like this before, now I have so things will be different in the future.

if he has no insurance:

1) break his legs
2) have quito pay him a visit

Wow, that's insane. It takes very little to create a $1,000 dollar or more repair. We have no-fault insurance here, which changes everything. But, insurance rates can be affected based on who caused the accident. What happens if this guy claims that you backed up into him???? Or he claims an injury???

I always protect myself with a police report...especially when the other guy is at fault. A rear ender almost always results in a ticket here....more protection for you regarding your insurance rates.

Good luck and keep us posted.

I called the police last night and they said even if I had called them that day unless someone was hurt badly they would not right a report or come out.

They told me to call my insurance, which I did, my insurance company is investigating his tag, VIN, and License. They are having me get another estimate and this may go under my uninsured motorist coverage.

My insurance company AIG, said that Allstate was not cooperating, AIG told them to look under a commercial policy since he has a commercial vehicle, supposodely.

AIG should have all of the information by early next week. A neighbor who works for Erie Insurance told me that Allstate has terrible customer service.
