Always appeal. Wait for the letter determining the outcome. If he's denied appeal the decision.he can do this without any help.

Unemployment is extremely frustrating to deal with. Had to deal with it a few years ago.
It depends on the state, but NY, you can only get unemployment if you're laid off or fired for incompetence. IE - showing up late to work, disagreeing with coworkers, insubordination mean you don't get unemployment.

he is pretty lucky he does not pay for his legal fees they are free

In NJ unless it was for a major infraction, he should get benefits. I believe that even if you are fired for doing something wrong, after a period of time the benefits start anyway.
Why doesnt he read the law himself? Living in NJ there are great public libraries in every little mile square town. Use them and get the info.

Id like to know that too. Any excuses aside, he needs to be out looking for a job. UI isnt a replacement for income.

At his age he needs to be on his own, not living at home waiting for UE benefits cause it could take a while in which he could of found another job.

I disagree, sorry vette, he needs to take care of himself, having a little money come in will do help a lot, he needs to stay healthy, focus on getting back. But UI is part of package when you work as an employee, in this case the unethical employer did everything to get out of paying UI. Down sizing is fine but what he experienced is illegal. He should contact DOL or State AJ's office and give them a written statement. Find other employees who has been treated the same.
My FIL (PHd) got laid off 2x, first time he did not even apply for UI, he was out of work for 1 year, next time he finally applied after a few months.
