Off road diesel used in your daily driver

I don't think it is checked regularly out here. Not hard to get your exemption with farm plates. You save fuel tax as the fuel is not supposed to be used on highway.
 
Ive heard stories of the State Police doing checks at livestock auctions in WI. But for the regular Joe that does not farm, they never get checked.

I used to have a diesel truck. Off-road diesel is all over around here. Its usually .50$ a gallon cheaper than on road diesel.

All diesel is the same sulpher. All ultra low sulpher. HAs been for at least 8 years.

This is America, however, if you refuse to allow a DOT officer to draw a sample of fuel from your diesel truck that you were driving on a public roadway, then that DOT officer my suspect you are using non-taxed fuel. That's probable cause. It's up to a judge to decide if issuing a search warrant would violate your right not to be illegally searched. The judge may issue a search warrant.

It is all about taxes, which are supposed to be (but which probably are not) for upkeep of the roads. If you use the fuel in a boat or in a farm vehicle, you are not using the roads, so no road tax.

Yes, but that's not the point. Try untaxed diesel here and see what happens, or refuse to submit taxes, and just respond that it's just tax money.

That is a Catch 22. If you consent, you get searched. If you refuse, its probable cause for the issuance of a warrant, and you get searched. That logic writes the Fourth Amendment out of existence.
 
Used to be pretty hot on it in The Yook, as you might expect, given the high tax on fuel.

I was stopped a few times in a (petrol) Landrover, then waved on when they'd checked the fuel type. Looked into the "Fuel Testing Laboratory" (white caravan) and there was a guy holding up a beaker to the window to see if it was pink. Might be more tech now.

There were rumours of stills to get the pink out, "run by organised crime". I suppose its hard to run a still if you're disorganised.

There were literally pieces of vehicle, broken-off pieces of vehicles, littering the roadside in Shreveport as I jounced through town at a snail's pace.

For shame, Louisiana, FOR SHAME!!!


In Illinois they're resurfacing a highway that was perfectly fine and previously resurfaced ~3-4 years ago. Meanwhile we have another highway 10 miles away that has several potholes so deep that trucks will swerve to avoid it or gain air when they bounce out of it.

When my uncle had his own rig and ran his own route from central PA to FED EX near Carlisle he would usually see guys stopped for this.
 
I have been once ,10 years ago in my pick up I came to what looked like a 'ride program' but they were dipping tanks.Rural area .
