Help with a yes or no answer on a job application

Seeking the master minds of BITOG to determine if YES or NO is the correct answer on this job application question. It seems yes for the first half of the question, no for the second half of the question. Of note I have never committed nor have been charged or convicted of any domestic violence or related crimes (or any crimes for that matter). I bring this up for review as I was recently disqualified for a position because of an erroneous box check.

I believe the answer for me is yes- but somehow got a like question checked wrong on a prior application.

Here is the question:

I have the ability to serve in this position as, in accordance with 18 USC, Section 922(g)(9) (Lautenberg Amendment), you have not been convicted of a misdemeanor crime of domestic violence and are prohibited from possessing firearms and ammunition?

A. Yes

B. No
 
Simple answer, YES. You have NOT been convicted....
The poorest part of the wording in the question is the following "and", which should be "or".

The correct answer is YES. Let's break the question down to understand why. Ignore the lined out text and associated commas since it is merely a qualifying descriptor of the specific code. As such, it has no impact on how you should interpret the rest of the question.

A conviction does not necessarily include the prohibition. The answer is "no" only if you are under a court order not to possess firearms as part of a domestic violence conviction.
 
The fact it goes from first person (I) to second person (you) in the same sentence is the first issue that arises and should be pointed out the HR. The way it reads, the HR person asking the question is being asked, by you, whether they have committed such an offense. I hate ****ty grammar in official documents. The correct answer is yes, but I would skip that workplace based on such a crap question.
 
Thanks Gents! I marked a like question "wrong", and now am super tuned in to not make an erroneous entry again. On almost all the questions reference Lautenberg Amendment, the answer is NO. The way this question is worded, the answer appears as you pointed out, YES.
 
Here is a similar question on a like application I am filling out, and the answer is no. Of note, it is the same organization, different directorate:

Conviction of a misdemeanor crime of domestic violence is disqualifying. A misdemeanor crime of domestic violence is any offense involving the use of physical force, or the threatened use of a deadly weapon, committed by a current or former domestic partner, parent, or guardian of the victim. Have you ever been convicted of a misdemeanor crime of domestic violence?

A. Yes

B. No

The real question is, do you really want to work for a company that employs recruiters that can't write cohesive sentences? I mean,

Is this supposed to imply YOU wrote this bit when you say, "I have the ability...." and if so, why does the second part, "you have not been convicted...." sound like somebody is asking you a question?

In my state, I have to answer pretty much the same question in order to get a fishing license. Answer “No” and you are automatically denied a fishing license. I’m not certain if those who check Female on the application have to answer the same question.

It seems anything that my state can do to poke men interested in sportsman endeavors in the eye are fair game.
