There was a legal notice in the USAWeekend mag with the Cincinnati Enquirer today claiming they sold the same products under different names as higher performance products and charged more for them. Products mentioned were Mobil Drive Clean 5w30, 10w30, 10W-40, 20W-50, 5W-20, HD 30, and HD 40; Mobil Clean, Mobil Multi Purpose ATF; Mobil ATF +3, Mobilube HD LS; Mobil Delvac Hydraulic 10W; Mobiltrans HD 10, HD 30, and HD 50, Mobilfluid 424, Mobilube HD Plus 80W-90 and HD Plus 85W-140; Mobilube HD 80W-90 and HD 85W-140; Mobilgear 626, 627, 629, 630, 632, 634, and 636; Exxon Nuto H 32, H 46, H 68, H 100, and H 150; Mobilux EP, Mobilith AW2; Mobil Pegasus 505; Mobil Almo 535, 529, and 532.

I think the lawyers smelled deep pockets $$$$$$$$.
 
Sounds a bit odd to me. These type of things turn me off to big corporations.
 
My guess is that 2 Mobil products on a retailers shelf with presumably the same make up have different prices. This inherently implies that the more expensive one is better. If it were a small company without deep pockets, you couldn't get a lawyer to touch it especially since I think there are differences (albeit small) between the listed products.
 
You would think if they were going to dig this deep they would have looked at Mobil Truck & SUV and Delvac 1. If they are the same there sure is a big price difference. Going by the list of products listed above, sounds like some small distributor going after shelf space from the big guy.
 
Hirev - It doesn't differentiate and say which ones are considered to be the "higher performance" products. I thought it strange that they even have greases listed and I am familiar with the Mobilgear 600 series....they are industrial products. Just raises a lot of questions.
 
When I buy baked beans, I look for the home brand that has identical specs to my favourite brand.

Look closely, and you WILL find one with identical calories, identical sodium and potassium, to the nmber.

When I see this, I immediately think...I'll buy this, it's a bargain at 50% off my name brand.

I don't immediately think "I'll sue my name brand".
 
Imagine not buying any products nor availing oneself of the services provided by "big corporations". Worse yet, what would become of the lawyers?

I think this is the issue with the lawsuit, since the complaint is that Mobil is selling the same fluids under different brand names for differing prices without informing consumers that they're the same fluids.

I don't see what the problem is. Lots of companies do this.

So ..is this a case of Oscar Meyer rebranding excess bacon production (for economy of production) and selling it to Aldi for @$1.69/lb ..as oppose to the OM label that gets $3.60/lb???

Or is this Mobil DC being sold as "Zeinith Acme Primo" with XYZ additive!! being sold for $6.24/quart??
