There is a reason why court appointments are fought like WW-IV. These justices are the defacto head of the legislature, with lifetime tenure. The system of checks and balances is far out of balance.
 
the only positive of this is: it goes back to the state legislatures and courts. people need to take action and call their reps and raise ****. there are movements in several states to restrict this kind of seizure.

even sdo'c, in her dissent, said that the supremes weren't necessarily qualified to issue a blanket judgement on this (then who is?)

the supreme court didn't make a decision that specifically allowed or prohibited this; they simply punted, albeit in the wrong direction.

Although I don't live in an affected area I will say that I really dislike the courts ability to write the law. I feel that the elected rulers of the land should get together and come up with a law rather than let a small group lawyers/judges make the decision.

Although I am highly against the concept..why worry about it? You can all sit and wring your hands over it or worry about more important issues. If and when it happens to you and/or yours then you can personally make a stand and voluntarily leave or go down blazing and be carried out feet first. It's as simple as that.

Unfortunately, the principle of taking anything away from any group to give to another one is so firmly entrenched that our republic can no longer peform in its proper framework. Legislators are too ready to buy votes with the public treasury.

my great grandmother's house in North Conway N.H. was taken in the early 1900s so the state could build a bridge and widen the road that leads into the center of north conway (the main drag, can't remember the route number maybe 16?)
they demo-ed the house and then decided not to expand the road. 75+ years later, the land still sits there and the roade still hasn't been expanded. what a prime chunk on property, less than a mile from the shopping areas.

i roll my eyes everytime i drive by it.
 
Sickening.

This establishes a new right for Walmart or any enterprise to take your house, solely on the basis that it can generate more tax dollars for the town than you can. Those new rights used to be YOUR rights.

Are you feeling safe in your home today? Better keep on eye out for developers touring the neighborhood.

How ironic would it be if the families in this area could somehow get the money to build a shopping mall, hotel, or whatever in the area where some of the judges live, and then get the city to throw their families out of their homes to make room for the development?
