God forbid they slow down to match road conditions. After a heavy snowfall, it takes time to clear the snow and until then, you have to slow down. The family of the driver is suing the province.

Same thing with drivers suing the city for pothole damage to their low profile wheels. The freeze-thaw cycles in the winter generate potholes. The city should not pay anything unless gross negligence on the part of the city can be proven. Same for pedestrians slipping on icy sidewalks. It takes time to clear sidewalks after a heavy snowfall and the city should not be liable unless there was gross neglibence.
 
People just don't have a clue. Seems people with the least experience are driving like it's summer. As an example, we're just getting school buses on the road this week after a historic snow fall Mar 15 -16, 4 hours north of Toronto.

My dad is a retired attorney. The reality is we the people are stupid. We serve on juries and decide on the amount of compensation in a civil suit and it's often absurd. Doesn't matter if its Texas of California. Texas has become a leader in nuclear verdicts.

There is jury selection, it’s hardly a representation of the general public.

In the US there are instances where the local government is liable once they've been notified of the pothole and a period of time has elapsed without repair. I've personally notified my county DOT of collapsed sections of highway and potholes which were always repaired within a week or so.

You are showing extreme ignorance of the horrible accident that killed this woman. The Highway 8 had an unplowed ramp of sold snow that had turned to ice on the outside of the 2nd lane. There was no margin for error at all and her car was the SECOND ONE that flew off the highway to land 80 feet below! the first car was a taxi, yah those guys never try to drive beyond the conditions, but taxi driver was injured but survived. Less than 3 hours between the first car plunge to the next one.

The Ontario Provincial Police should have closed the 2nd lane of the flyover before the 2nd car plunged off the bridge, they didn't and now there will be a lawsuit. The issue is that there had been no regular snowplowing of the shoulder of the 2 lane bridge, and the snow accumulated and froze to make a perfect ramp to launch any car that went over the yellow line.

I hope the Ontario Provincial Police and the Ministry of Transport Ontario get their teeth kicked in when this finishes the trial.
 
I agree and disagree. I travel a lot for work and if I'm in a big city and don't know the roads I'm going with the flow of traffic. If a big pothole takes out my axle I'm exploring my options.

So what you are saying is she wasn't paying attention to road conditions.
 
This is reminiscent of a post on the my local FB group about an 11 yr old blaming the city for his parent's accident. They were driving a newer Ford Escape and dead centered a utility pole at 35+ mph. It was the first snowfall of the year and he went on FB and blamed the city for their injuries. I was one of the few voices of reason stating plainly that they didn't drive as the conditions warranted and paid the price. I little crass maybe but seriously, you collapsed the entire front of the vehicle so you obviously were not driving appropriately. The general consensus was I was being mean by telling the truth and the boy should sue the city. :rolleyes:
