Since he was quoting Texas code, my reply was solely about Texas.
But even in Texas use of lethal force is going to have to be justified and while the code might allow that, a DA might not.
I suspect that law was written to address horse thieves - in which the theft of a horse years ago - was tantamount to killing a man by taking his livelihood and transportation all at once.
To kill someone over a car, that is insured, in an apartment lot, in modern times, is a very different matter, with much less impact than the loss of a horse had back when the law was written.
