TX cops raid farm for marijuana only find tomatoes

The worst part with the erroneous raid is they still destroyed and confiscated lots of plants and other items. Just thug behavior really.

"We've never hurt anybody," Eaker said. "This is our land. We have the right to be secure in our person and our property. Period. That's undebatable."

According to the search warrant, an undercover narcotics agent had visited the farm to investigate an anonymous tip that Eaker was growing marijuana in a garden surrounded by bamboo.

A Texas Department of Public Safety aircraft conducted aerial surveillance of the Garden of Eden property on July 30, according to the warrant. Photographs of the garden surrounded by bamboo, police stated in the warrant, were "consistent with marijuana."

But they were tomatoes.

"They can't even tell the difference between tomato plants and a marijuana drug cartel; that's just really bad intel," Eaker said. "I think they were hoping that was true. And I think that they made a mistake and I think that they know they made a mistake."

While code enforcement reported finding violations including high weeds and grass and standing water, police did not uncover any marijuana plants anywhere on the property. According to investigators, there are no food handler permits on file for the property or its residents.

Code compliance officers mowed the property and removed wild and cultivated plants including blackberries and okra. Officers also confiscated pallets, tires and cardboard that the members said they repurposed and reused for various projects.

"We had mass amounts of materials taken,” Eaker said. “If you saw the list, it's pages and pages and pages of materials taken. That wasn't junk. That wasn't trash."

Eaker and the other residents of the farm are demanding an apology from police and compensation for damage to their property during the raid.

If you read up on this these types of raids have increased DRAMATICALLY over the past.

I guess when all you have is a hammer then everything begins to look like a nail. The cops are going to have to get used to the mary jane growers anyway, too many states have legalized or de-criminalized it.
 
One needs a "food handler permit" to grow tomatoes? Give me a break.

Article is not clear if said tomatoes were up for sale or consumed on-farm. Sounds like a commune?

Typical... wasting tax dollars to find marijuana growers.Cant they spend their time on catching real criminals and burglars? Not like there is a lack of other things to do.

Truth. For all sorts of things too. A couple weeks ago an animal rescue farm was illegally invaded looking for some fawn they had rescued (no permit). Idiot cops killed the fawn in the raid.

The cops got all this federal money and support (drugs/terrorism), now they must use it. Disgusting. I think people on all sides of the spectrum can see how stupid this is. Oddly our police force gets all kinds of fancy cars (very frequently) and still scream they are out of money.
 
These raids are ridiculous. It's getting to the point that they will bust your door down for an outstanding parking ticket.
 
This happens more than you think. A neighbor near me runs a legal business in a shop behind his house restoring cars and the cops broke the door down woth guns drawn thinking it waa a chop shop.

At the same time they held his wife and 5 yr old in the house at gunpoint. Eventually cuffing the wife and kid! Kid got zip ties.

After finding nothing everybody was released. The pd bought a new door and a lawyer was notified. The pd settled out of court as long as the news was not notified.
 
You might wish to follow REASON Magazines web site. A professional, mainstream magazine with a good web site that often looks at these situations.
 
I believe that a lot of this War on Drugs, is ridiculous. I never have done any illegal drugs but that being said I still believe that alcohol causes far more problems than marijuana. The only reason the government cares about marijuana is because it is not taxed. If it was sold in stores like cigarettes are and they charged tax it would suddenly be okay. I'd much rather the cops spend their time arresting murderers and rapists and just leave Cheech and Chong alone.

Most likely they hoped to find a drug or other violation that would allow them to begin a forfeiture proceeding against the property.

In most instances, the local police get to keep a large part of the proceeds of this ill gotten property.

The property owners will still get a huge bill, about ten times what it would cost in the free market, for the mowing and trash clean up. And a lien on their property to secure it, so they are still at risk of losing it, just to a different bunch of tax fattened morons.

The police are completely out of control. The para militarization of the police is responsible for this. It is an absolutely terrible public policy that should be stopped immediately. I have seen full on swat raids for food stamp violations. Police funding should be cut to draconian levels.

Yep! and that is exactly the reason they were there. If they would have found 200K in weed growing instead of vegetables most likey they would have lost their home.
 
Why does our government get so exited about marijuana? Has anyone ever died from using marijuana? Cigarettes are far, FAR more deadly than marijuana will ever be. My older brother lost his life to pancreatic cancer at the young age of 61. He was a heavy smoker. The ironic thing about it is, he told me that after being in the hospital for two weeks, he no longer had a craving for cigarettes.

I think seizing property is a big part of the motivation and is totally unacceptable. The thuggish manner in which they go about accomplishing this makes me think they just like acting as thugs. I think they mostly just like pushing people around and taking their stuff away even if they're just going to destroy it.
 
I bet the cops chopped up all the tomato plants and took them all away and made a huge bonfire. I'd also bet that most of the cops were downwind from this big bonfire hoping to get a buzz from all the weed...er...tomato plants.
