EBay's rules are on the buyer's side, sellers have almost no recourse, so you have that on your side.

Slightly OT:
I recently sold something on ebay as a lot of 4. one was freight damaged and the buyer whined because it was no longer 4 ($25 total sale mind you). She ignored that my auctions say no returns and no responsibility for freight damage, insurance mandatory. I ended up taking the 3 back and selling them for more than a sold the 4 for. I had no way to give anything but positive feedback. I then listed them as individual (qty 3) and it confused the heck out of 3 potential buyers even though I stated it in large red letters in the listing.
